Pay Fixation on Promotion or MACP Governed by CCS (Revised Pay) Rules 2016 and Fundamental Rules: Finance Ministry
The Government has clarified in Parliament that pay fixation on promotion or financial upgradation of Central Government employees after 1 January 2016 is governed by the Central Civil Services (Revised Pay) Rules, 2016 and the Fundamental Rules.
The clarification was provided by Minister of State for Finance Shri Pankaj Chaudhary in a written reply to an Unstarred Question in the Lok Sabha.
Pay Fixation Rules After 1 January 2016
According to the Ministry of Finance, pay fixation for Central Government employees who receive promotion or financial upgradation on or after 1 January 2016 is regulated under:
- Central Civil Services (Revised Pay) Rules, 2016
- Fundamental Rules (FRs)
These statutory rules govern how pay is fixed when employees receive promotion or financial upgradation benefits.
Cases of Employees Promoted Between 01.01.2016 and 01.07.2016
The Parliament question also raised a specific issue relating to employees who were promoted or granted financial upgradation under the Modified Assured Career Progression (MACP) Scheme between 1 January 2016 and 1 July 2016.
It asked whether such employees—who exercised the option under Rule 5 of the CCS (Revised Pay) Rules, 2016—are eligible to exercise the option under the proviso to FR 22(i)(a)(1) to regulate their pay and switch to the 7th CPC Pay Matrix from their next increment date, i.e., 1 July 2016.
Government’s Response
The Government stated that such cases are examined under the provisions of:
- Rule 5 of the CCS (Revised Pay) Rules, 2016, and
- Department of Personnel and Training Office Memorandum dated 27 July 2017
The Ministry indicated that matters relating to these cases are dealt with according to the provisions of these rules and the DoPT instructions.
