CVC Issues Consolidated Master Circular on Timely Initiation and Finalisation of Disciplinary Action

The Central Vigilance Commission (CVC) has issued Master Circular No. 08/MC/2026 consolidating all its previous instructions relating to the timely initiation and finalisation of disciplinary action in Central Government organisations under its jurisdiction. The new circular supersedes all earlier guidelines on the subject and aims to ensure faster, uniform and more effective handling of disciplinary proceedings.

The circular applies to Central Government Ministries, Departments, CPSEs, Public Sector Banks, Insurance Companies and other organisations under the CVC’s advisory jurisdiction.

Key Highlights

Standard timelines prescribed

To reduce delays, the CVC has laid down a model timeline covering every major stage of disciplinary proceedings, including:

  • Decision on vigilance angle in complaints.
  • Completion of investigation.
  • Seeking First Stage Advice (FSA) from the Commission.
  • Issue of charge sheet.
  • Appointment of Inquiry Officer (IO) and Presenting Officer (PO).
  • Completion of departmental inquiry.
  • Passing of final disciplinary orders.

The Commission has stressed that disciplinary cases should progress without avoidable delays so that both innocent and guilty officials are not prejudiced by prolonged proceedings.

Six-month target for departmental inquiry

The circular advises that the departmental inquiry itself should normally be completed within six months from the appointment of the Inquiry Officer. It also provides stage-wise timelines for preliminary hearings, inspection of documents, examination of witnesses, written briefs and submission of the inquiry report.

Measures to reduce delays

The CVC has identified several common reasons for delayed disciplinary proceedings, including:

  • Defective charge sheets.
  • Non-availability of documents.
  • Frequent adjournments.
  • Repeated changes of Inquiry Officers or Presenting Officers.
  • Inadequate monitoring by disciplinary authorities.

To address these issues, organisations have been advised to:

  • Ensure timely availability of all relied-upon documents.
  • Appoint Inquiry Officers and Presenting Officers simultaneously wherever possible.
  • Minimise changes of IOs and POs.
  • Use video conferencing where appropriate to continue inquiries after transfers.
  • Conduct hearings on a day-to-day basis as far as practicable.
  • Closely monitor pending disciplinary cases.

Monthly progress reporting

Inquiry Officers have been directed to submit monthly progress reports on pending inquiries to the Disciplinary Authority, with copies to the Chief Vigilance Officer (CVO), enabling closer monitoring and timely intervention wherever delays occur.

Faster disposal of bias petitions

Recognising that allegations of bias against Inquiry Officers often delay proceedings, the Commission has advised that such petitions should be disposed of preferably within 30 days, while following the principles of natural justice.

Uniform processing across organisations

The circular also calls for reducing unnecessary processing levels in vigilance cases and adopting greater uniformity across organisations to improve efficiency and speed.

Earlier instructions superseded

With the issue of Master Circular No. 08/MC/2026, all previous CVC circulars, office memoranda and guidelines relating to the timely initiation and finalisation of disciplinary action stand consolidated and superseded. The Commission has also invited suggestions from stakeholders for further improvement of the master circular.
