CVC Issues New Master Circular on Processing of PIDPI Complaints, Supersedes Earlier Guidelines

CVC Master Circular 2026 on PIDPI Complaints

The Central Vigilance Commission (CVC) has issued Master Circular No. 04/MC/2026, consolidating and updating the guidelines for processing complaints received under the Public Interest Disclosure and Protection of Informers (PIDPI) Resolution, 2004. The circular replaces all previous instructions issued by the Commission on the subject and aims to provide a single, comprehensive reference for Ministries, Departments, Public Sector Enterprises, Public Sector Banks, Insurance Companies, Autonomous Bodies, and other organizations under the Commission’s jurisdiction.

Single Reference Document for PIDPI Complaints

According to the CVC, the new Master Circular has been issued to bring together various circulars, office orders, and guidelines released over the years regarding the handling of whistleblower complaints. By consolidating these instructions into one document, the Commission intends to ensure uniformity and clarity in the processing of complaints received under the PIDPI Resolution.

The circular came into effect from the date of its issuance and applies to all Ministries, Departments, and organizations covered under the jurisdiction of the Central Vigilance Commission.

Key Features of the Master Circular

The Master Circular reiterates the powers and responsibilities of the Central Vigilance Commission under the PIDPI Resolution. Some of the important provisions include:

  • The Commission may receive written complaints or disclosures regarding corruption, misuse of office, or abuse of authority by public servants.
  • The identity of the complainant must remain confidential throughout the inquiry or investigation.
  • The Commission may seek comments or explanations from the concerned department while safeguarding the whistleblower’s identity.
  • Assistance from the Central Bureau of Investigation (CBI) or other agencies may be sought wherever necessary during investigations.
  • Appropriate directions may be issued to government authorities to ensure protection of complainants and witnesses.
  • If the identity of the complainant is disclosed without authorization, the Commission may recommend suitable action against the responsible individual or agency.
  • Complaints found to be motivated or vexatious may invite appropriate action by the Commission.

Revised Procedure for Processing Complaints

The circular lays down a detailed procedure for processing complaints received under the PIDPI mechanism.

Where the Commission considers a complaint fit for investigation, it may forward the matter to the concerned Chief Vigilance Officer (CVO) or organization for a Factual Report (FR) or Investigation Report (I&R). Reports are required to be submitted within the prescribed timelines through the Commission’s online Complaint Management System (CMS).

The Commission has also emphasized that organizations should not delay investigations and must seek extension of time only in exceptional circumstances with adequate justification.

The circular further specifies that complaints should not be treated as anonymous merely because the complainant’s identity has been withheld by the Commission for confidentiality.

Stronger Protection for Whistleblowers

A significant focus of the Master Circular is the protection of whistleblowers.

It directs organizations to maintain complete confidentiality of complainants during investigations and ensure that they are not subjected to harassment or victimization. If a complainant’s identity becomes known during the course of an inquiry, the concerned authorities are required to take all necessary steps to prevent any form of retaliation.

Where there is a perceived threat to the complainant or witnesses, the Commission may issue appropriate directions to the concerned government authorities to provide necessary protection.

Supervision by Designated Authorities

The Master Circular also strengthens the role of Designated Authorities responsible for handling PIDPI complaints.

These authorities are required to:

  • Monitor complaints received under the PIDPI Resolution.
  • Submit quarterly performance reports to the Commission.
  • Report cases involving alleged harassment or victimization of whistleblowers.
  • Ensure timely processing of complaints and compliance with Commission directions.

Guidelines for Lodging PIDPI Complaints

The circular reiterates the prescribed procedure for submitting complaints under the PIDPI Resolution.

Complaints may be sent to the Commission or the designated authority through registered post, speed post, or other notified means. The Commission has also referred to separate Public Notice No. 11/MC/2026, which provides detailed procedures for lodging complaints under the PIDPI Resolution.

Annexure Prescribes Format for Factual Reports

To bring greater uniformity in reporting, the Master Circular includes an annexure prescribing the format for submission of Factual Reports by organizations. The format requires reporting authorities to provide:

  • A clear statement of each allegation.
  • Relevant facts and supporting records.
  • Details of officials involved.
  • The sequence of events and findings based on available records.

The circular clarifies that the Chief Vigilance Officer is not required to express any opinion regarding the culpability of officials while submitting the factual report.
