Government Seeks Measures to Prevent Waiver of Recovery of Wrongful or Excess Payments to Government Employees

Department of Expenditure asks Ministries and Departments to strengthen timely audit of pay fixation and identify reasons for excess payments being detected only at the fag end of service

The Department of Expenditure, Ministry of Finance, has initiated a fresh exercise to strengthen mechanisms for preventing the waiver of recovery of wrongful or excess payments made to Government servants.

Through an Office Memorandum dated 12 August 2026, the Internal Audit Division of the Controller General of Accounts (CGA) has sought detailed inputs from Ministries and Departments on compliance with existing instructions for timely audit of pay fixation orders and the reasons why irregularities continue to be detected towards the end of an employee’s service.

The move comes after the Department of Expenditure continued to receive proposals seeking waiver of recovery of excess payments made to Government employees.

Existing Instructions on Audit of Pay Fixation

The Office Memorandum recalls that the Department of Personnel and Training (DoP&T) had issued instructions on 3 October 2022 advising Ministries and Departments to conduct an audit of pay fixation orders arising from:

  • MACP
  • ACP
  • Financial upgradation
  • Increment
  • Promotion
  • Other related pay fixation events

The audit is required to be carried out within three months of the issue of such orders.

The instructions also provide for the audit of previous pay fixation orders in respect of employees who are due to retire within the next four years.

The objective of these requirements is to ensure that errors in pay fixation are identified and corrected at an early stage, rather than allowing excess payments to accumulate over several years.

Department of Expenditure Concerned Over Delayed Detection

Despite the instructions for timely audit, the Department of Expenditure has observed that it continues to receive cases involving requests for waiver of recovery of excess payments.

A key concern highlighted in the latest communication is that such irregularities are sometimes detected only at the fag end of the service of Government employees.

When an incorrect pay fixation remains undetected for a prolonged period, the resulting excess payment may accumulate over several years. This can subsequently lead to a recovery issue when the employee is approaching retirement.

The Department is therefore seeking to understand why the prescribed audit mechanism is not preventing such cases from being detected at a much earlier stage.

Four Key Areas on Which Inputs Have Been Sought

The Internal Audit Wings (IAWs) functioning under Ministries and Departments have been asked to provide detailed inputs on four specific aspects.

1. Compliance with Timely Audit Requirements

Ministries and Departments have been asked to indicate whether the prescribed instructions regarding the timely audit of pay fixation orders are being followed.

This includes the requirement to audit pay fixation orders within three months of their issue.

2. Why Irregularities Are Detected at the End of Service

The Department has specifically sought reasons why observations relating to incorrect or excess pay fixation continue to arise at the fag end of an employee’s service, despite the requirement for audit within three months.

This seeks to identify possible gaps in the existing system that allow incorrect pay fixation to remain undetected for extended periods.

3. Challenges Faced During Audit and Inspection

The Internal Audit Wings have also been asked to identify any challenges faced by auditors during audit or inspection in Ministries and Departments that result in cases remaining undetected.

4. Action Taken to Address the Challenges

The Ministries and Departments have further been asked to provide details of the action taken, if any, to overcome such challenges and improve the effectiveness of the audit process.

Inputs to Be Submitted Within One Week

The Office Memorandum requests the Internal Audit Wings under the concerned Ministries and Departments to furnish their detailed inputs on the four points.

The response is required to be submitted within one week from the date of issue of the communication.

The Department has provided an official email address, [email protected], for submission of the information. The communication also states that the inputs are to be submitted through a Google Form sent through email to the Ministries and Departments.

Focus on Preventing Excess Payments at Source

The latest initiative indicates a focus on preventing cases of wrongful or excess payment from continuing undetected for long periods.

Rather than dealing with excess payments only when an employee is nearing retirement, the existing audit framework is intended to identify pay fixation errors soon after they occur.

Timely verification of pay fixation following MACP, ACP, financial upgradation, increments and promotions can help identify discrepancies at an early stage and reduce the possibility of large accumulated excess payments.

The Department of Expenditure’s latest exercise is aimed at identifying the practical difficulties that may be preventing Ministries and Departments from achieving this objective.

What This Means for Government Employees

For Central Government employees, the communication primarily concerns the administrative and audit mechanisms used by Ministries and Departments to verify pay fixation.

The document does not announce a new general recovery rule or a new recovery rate for Government employees. Instead, it seeks information from Ministries and Departments on why existing instructions for timely audit are not always resulting in early detection of incorrect pay fixation.

The exercise may help the Government identify gaps in the audit process and strengthen mechanisms for preventing wrongful or excess payments in the future.
