Controller General of Defence Accounts announced revision of pay by grant of benefit of stepping up MACP @ Rs.5400/- w.e.f. 01/09/2008 to AAOs at par with Sr. Auditors in light of judgement of the Madras Bench in OA 966 81967 of 2009.

Subject: Revision of pay by grant of benefit of stepping up/ MACP @Rs. 5400/- w.e.f. 01/09/2008 to AAOs at par with Sr. Auditors

Reference:- HQrs. office circular No. AN/X1/11051/MACP/AAO/GP 5400 dated 07/05/2015.

With reference to above, it is mentioned here that aggrieved with the decision of DOP&T on the above subject, communicated vide HQrs circular cited above, number of OAs have been filed in various Hon’ble CAT Benches by SO (A)/ AAOs of the department, to extend the benefit as granted to AAOs of Pr. AE (A&E) Chennai/ C&AG by Hon’ble CAT Madras Bench vide its order dated 29/12/2010. The similar type of orders have been delivered by various Benches of Hon’ble CATs. The contents of the order are as under:

“Respondents to examine the case of the present applicants Whether they are similarly situated and if so, grant the same benefits in light of judgement of the Madras Bench in OA 966 81967 of 2009. Respondents shall the communicate their decision to the applicants through a reasoned order”.

Now one of the Controllers has sought for guidelines on the issue from the HQrs office so that the factual position may be appraised to the Hon’ble CAT within time frame to avoid adverse comments from the Hon’ble CATs.

As such, to take the holistic view in the matter, it is advised that being an Appointing Authority in the case, the issue may be examined as to whether SOs (A)/ AAOs of DAD, who are applicants in various OAs, are similarly situated with the applicants of OAs NO. 966 967 of 2009 filed by AAOs of Pr. AE (A&E) Chennai/ C&AG in terms of Recruitment Rules, Grade Pay & Cadre structuring etc. and accordingly, apprise the position/ facts to this office immediately so that the matter may be taken up with the Ministry as well as for appraisal of the Hon’ble CATs within time frame.
