Transfer policy for Physically Challenged Government Employees
A suggestion has been made that physically handicapped candidates appointed under the Government should preferably be posted in their native places or at least in their native district. The matter has been examined carefully by DOPT and following decision was taken vide Office Memorandum NO. A-B 14017/41/90-Estt (RR) dated 10.05.1990
It may not be possible or desirable to lay down that physically handicapped employees belonging to Group-A or Group-B who have all India transfer liability should be posted near their native places. However, in the case of holders of Group-C or Group-D posts who have been recruited on regional basis and who are physically handicapped, such persons may be given posting, as far as possible, subject to administrative constraints, near their native places within the region.
Requests from physically handicapped employees for transfer to or near their native places may also be given preference.
However, the representations made by various Group A and Group B Officers were later considered by Government and it was decided the same benefit extended to Group C and Group D physically challenged employees will also be applicable to Group A and Group B officers. This decision was communicated by DOPT in the office memorandum No: AB 14017/16/2002-Estt.(RR) 13.03.2002. The decision is as follows
It is further clarified that the guideline contained in para 2 of this Department’s O.M. dated 10.5.1990 that requests from physically handicapped employees for transfer to or near their native places may also be given preference, covers physically handicapped employees in Groups A, B, C and D.
I was recruited in Central government under normal quota. But i have orthopedic disability(40%). My office admin people say that for claiming the exemption under 80G you should be recruited form physically handicap quota. Please give some comment on this. can i claim IT exemption ?

You can avail the exemption of Rs.50,000/- under 80G because you are Phy. chall. person with the disability more than 40%. There is no matter whether you are recruited under the normal quota or physically handicap quota.
1. Yes. You can submit the papers before your DDO in the prescribed format, quoting Persons With Disabilities Act 1995.
2. File an RTI application with the CPIO of your office, seeking the quasi judicial reasons on the decision of of your office to deny you this exemption. Later using this information, file a complain with the Chief Commissioner of Disabilities.
3. Keep posting all such issues related to handicapped staff on this website.

I am working in Central Govt. and I have orthopaedic disability 60%. My officers required/pressing for late sitting which is create difficulties for me. Whether any rule/circular is exist to protect me.
There is no such forcing/rule to ask an employee to work after nominated working hours, beyond the consent of an employee whether physically handicapped or not.
No body can force you to work after duty hours without your will.

Sir, I am a physically handicapped with 58% (both leg). I am join govt. service since 04-08-1989 as a LDC. Presently I am promoted as Group-B Gazetted Officer and transfer to another deptt. within office complex. I am submit an application for transfer my nativ place which is far at my residence 13 k.m. up-down. (presently my office which is far at my residence 36 k.m. up-down). But, my new office director not consider my application for transfer. Sir, i am asking a question as per DOPT letter dated 13-03-2002, can I eligible for transfer.

Yes you can very well get it. See the order clearly it is applicable to Group A, B, C & D

I am grateful to you that you made rules for us. I am a physical handicaped. I am a IInd grade teacher of English posted in Sadul Sports School in Bikaner Rajasthan. I have been transferred here 6 months ago. This school is nearly to my native place. Now the government have put the bane from teacher transfer. So I am requesting you not to remove me from here. Because I am an albinism due to it I have problems in visioning.
