DoPPW Clarifies Rules on Pension and Family Pension Claims Under CCS (Pension) Rules, 2021
The Department of Pension & Pensioners’ Welfare (DoPPW) under the Ministry of Personnel, Public Grievances and Pensions has issued a clarification regarding claims to pension and family pension under the Central Civil Services (Pension) Rules, 2021. The Office Memorandum (O.M. No. 38/10(03)/2025-P&PW(A)) was released on October 30, 2025.
Applicability of Rules
The memorandum reiterates that any claim to pension or family pension will be governed by the provisions of the CCS (Pension) Rules, 2021 that are in force at the time a government servant retires, is retired, discharged, allowed to resign, or dies, as applicable.
This means that the pensionary benefits will be regulated according to the rules valid on the date of cessation of service or death, ensuring uniformity and clarity across ministries and departments.
Treatment of the Last Working Day
The DoPPW has further clarified that the day of retirement, discharge, resignation, or death of a government servant shall be treated as a completed working day.
In other words, the employee is considered to have served a full day on their last working day.
However, in cases where an employee was on leave or under suspension immediately before retirement or death, the last day will be treated as part of that leave or suspension period.
This clarification eliminates ambiguity regarding the treatment of the final day of service for pension and family pension calculations.
