Subject: Implementation of court orders for grant of NFSG on the basis of judgment of Hon’ble High Court of Madras in WP No. 13225/2010 (Subramaniam Case)- regarding
Sir,
I am directed to say that a number of OAs have been filed by Inspectors/ Superintendents in different benches of Hon’ble Central Administrative Tribunal, seeking benefits similar to M Subramaniam case, which is related to grant of benefits of Grade Pay of Rs 5400/- in PB2 to those Inspectors who have completed four years of regular service in the grade Pay of Rs 4800/-, granted due to ACP/MACP.
2. On the basis of advice of Department of Expenditure, we have been implementing the Court orders for extending the benefit to all applicants whose cases are similar and covered in order of Hon’ble Madras High Court dated 6.9.2010 in WP 13225/2010 against which SLP was dismissed .
3. All cadre controlling of CGST/Custom are requested to provide the details of cases similar to Subramaniam case, implemented in their Commissionerate /Directorate and also details of compliance report, if any, filed in Hon’ble Courts/Tribunals, to Board on priority.
