Sub: Departmental Representative (DR) in quasi-judicial proceedings-Regarding.
Sir/Madam,
It is brought to the notice of the Head Office that in certain quasi-judicial proceedings under section 7A of the EPF & MP Act, 1952, Accounts Officers have been allowed to appear as Departmental Representatives. The functional roles of Accounts Officer (AO) and Enforcement Officer (EO) are altogether different and it is clarified that under no circumstances an AO shall be allowed to appear as departmental representative in any 7A inquiry.
2. Hence, all ZOs/ROs are advised to ensure that only an Enforcement Officer appears as DR in such proceedings. Any violation will be viewed seriously.
