Sub: Pay fixation of medically de-categorised running staff in an alternative post.
As the Railway administrations are aware, in terms of instructions contained in RBE no 171/2019, while fixing the pay of medically de-categorized running staff in an alternative post, if the resultant pay (after adding of 30% of pay) does not correspond to any cell, in the same pay level, then the pay will be fixed in the next below cell of the same pay level, and the difference in pay is protected as personal pay which will be adjusted in future increments.
It has come to notice that some of the Zonal Railways have interpreted the provisions differently than as originally envisaged. The differential interpretation by some railways has been cited by the employees of other Railways before tribunals in support of their application. It has thus become important to clarify the issue, for bringing uniformity in application of the provisions of the above mentioned instructions (RBE No. 171/2019).
In view of the above, the methodology being adopted on your Railway for Implementation of the above instructions specially with respect to fixation of pay level may please be advised.
