7th CPC: Government Clarifies Rule on Next Increment in Pay Stepping Up Cases
The Government has clarified in Parliament that the date of next annual increment under the 7th Central Pay Commission pay structure is governed by Rule 10 of the Central Civil Services (Revised Pay) Rules, 2016, including in cases involving stepping up of pay.
The clarification was provided by the Minister of State in the Ministry of Finance, Shri Pankaj Chaudhary, in a written reply to an unstarred question in the Lok Sabha on March 9, 2026.
Increment Rules Under 7th CPC Pay Structure
Responding to the question regarding regulation of increments when the pay of a senior employee is stepped up to match that of a junior under Rule 7(10) of the CCS (Revised Pay) Rules, 2016, the Government stated that the date of the next increment is governed by Rule 10 of the same rules.
Delhi High Court Judgment
The Parliament question also referred to a judgment of the Delhi High Court dated October 5, 2023 in W.P. (C) No. 12452/2023, which reportedly held that stepping up of pay is personal to the senior employee and intended only to remove the anomaly of a junior drawing higher pay.
In response, the Government stated that the judgment is a matter of public record and available on the official website of the Delhi High Court.
Overriding Effect of CCS (RP) Rules, 2016
The Government also explained the provisions of Rule 15 of the CCS (Revised Pay) Rules, 2016, which deals with the overriding effect of the rules.
According to the reply, Rule 15 provides that the provisions of earlier pay revision rules and the Fundamental Rules shall not apply where pay is regulated under the CCS (Revised Pay) Rules, 2016 to the extent that they are inconsistent with these rules.
Implementation of the Court Judgment
On whether general instructions or orders would be issued following the Delhi High Court judgment, the Government stated that the judgment dated October 5, 2023 has been implemented in respect of the applicant of the case.
