Sub: Amendment of Recruitment Rule of Assistant Engineer (Civil) and Assistant Engineer (Electrical).
Objections are invited from all concerned on the proposed amendment in Recruitment Rule in the grade of Assistant Engineer (Civil) and Assistant Engineer (Electrical) notified by the Department of Telecommunication for the Department of Telecommunications and the Department of Posts Civil Engineering Wing (Group B Gazetted Officers) and adopted by the Department of Posts mutatis mutandis in accordance to Cadre Management Transfer order of DoT vide OM No.32-7/2008- CWG dated 16-08-2011 for the RR notified vide Gazette Notification GSR 603 notified in Gazette on 11th November, 1992. Copy of the proposed draft amendment approved by the Secretary (Posts) is attached herewith. G.S.R. 603.- In exercised of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Telecommunications and Department of Posts Civil Engineering Wing (Group B Gazetted Officers) Recruitment Rules, 1992 in so far as they relate to the post of Assistant Engineer (Civil), the President hereby makes the following rules to regulate the method of Recruitment to the posts of Assistant Engineer (Civil) in the Civil Wing of the Department of Pods of the Ministry of Communications, namely: —
1. Short title and Commencement, –
(1) These Rules may be called the Department of Posts Assistant Engineer (Civil) in Civil Wing Recruitment Rules, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application:
These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules.
3. Number of posts, Classification and scale of pay :
The number of the said posts,their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule.
4. Method of recruitment, age limit, qualifications etc.-:
The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in the column 5 to 13 of the said Schedule.
5. Disqualifications : No person,
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, Shall be eligible for appointment to any of the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party in the marriage and that there are other grounds for so doing, exempt any person from operation of this rules.
6. Initial constitution of the posts:
(1) All Gazetted officers holding the posts of Assistant Engineer (Civil) on regular basis in the Civil Wing of the Department of Posts on the basis of commencement of these rules shall be deemed to have been appointed under these rules to the respective posts from the date they were regularly appointed to the above posts
(2) The regular continuous service of officers referred to in sub-rule (1) above before the commencement of these rules shall count for the purpose of probation, qualifying service for promotion, confirmation and pension in the service.
7. Power to relax :
Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order, for reason to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons
8. Savings:
Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen or any other special categories of persons, in accordance with the orders issued by the Central Government from time to time.

Now, when the provision for promotion by selection has been reduced to 5 years than earlier provision of 8 years, the difference of only 1 year for promotion through LDCE vis a vis through promotion by selection will have little or no effect on the availability of officer in the grade. Further, reduced number of posts in the feeder grade of JE (C) to 195 also doesn’t justify conveying LDCE. As per DOPT OM of 31.3.2015, filling up of posts only by promotion requires ratio of posts in the grade to the feeder grade as 1 is to 3 or higher as against the ratio of 1 is to 1.35 available in the instant case. |

(Period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not to exceed three years.The maximum age limit for appointment by deputation shalI be not exceeding fifty six years as on the closing date of receipt of application). | Amendment in requirement of regular service in the feeder grade has been proposed in accordance to DOPT OM dated 31.12.2010 and in accordance to Central Engineering Group ‘IV Service Recruitment (Amendment) Rules, 2010 of CPWD, Ministry of Urban Development.
