    My scale has been upagraded in 6th PC from 5000-8000 to 6500-10500 which is effective from 1/1/2006. Pl clarify whether my basic may be taken 6500 for (fixation of pay )muptiplying into 1.86 . It is relevent to mention that my my basic was 5450 on 1/1/06 in pay sacle 5000-8000 before upagradation to 6500-10500..

  14. This is in connection with medical claim. My two medical claim rejected by PAO saying that you have taken followup treatment from the hospital which is decognised/from AMA. Earlier hospital was recognised and later on decognised. Please let me know whther followup treatment taken unknowingly from the decognised hospital/AMA is admissible or otherwise.   22. sir, In the new children education allowance, what is meant by fee for any aid or appliance used by the child ? what about the fee paid for the school bus . It is an aid
    used by the child in connection with the studies. Why only cost of one set of shoes is reimbursible while 2 sets of shoes, (one black and one white) are used by the children .please reply.

    i was appointed as senior lab assistant in the scale of 4500-125-7000 in december 1999, and my next promotion time is eight years for next post of senior scientific assistant having pay scale of 5500-9000(Pre Revised). i have completed eight years in december 2007. and i will complete the ten years in december 2009.
    so please guide if i got the ACP first and then promotion , then what will be my basic after ACP and promotion.

    Presently I am serving in Central Govt. since last 20 years as a stenography instructor in Labour Ministry Department.

    Earlier to this I was in State (Gujarat) Govt. for 8 years. I was recruited inn Central Government through proper channel and my recruitment was direct recruitment.

    My query is whether service rendered with State Govt. would be treated as ‘Qualifying Service’ for the retirement benefits? Please reply with reference to government rule no., if possible.

I would like to know whether the Initial Equipment Allowance for Central Excise Inspectors has been enhanced to Rs.3000/- from the previous amount of Rs.1500/- after VI CPC as it was mentioned that all allowances would be doubled with the implementation of the Central Revised Pay Rules, 2008. Is there any order issued by the Ministry?

For an intimation u/r 18(2) of CCS (Conduct) Rules, 1964 for acquiring an immovable property where,inter alia, the applicant has indicated that he wishes to take an interest free loan from his relative, can the department seek the source of income of such relative even though the relative has furnished his consent letter and a copy of his employment certificate? If so, is there any rule or GOI decision on such matters both in the affirmative or otherwise?

    1. In such situation, department can insist for transaction through bank i.e interest free loan has to be received by the employee in the form of a cheque or DD.

  38. I was on CCL from 18th October,2008 till 12t March, 2010. I am being denied increment both for the year 2009 and 2010 on grounds of non-continuous service. Can anybody tell me whether it is correct and if not, how do i convice my office for increment?

    1. Dear thomas
      After6 CPC 6 months service is required to get an increment. The period of 6 months is calculated from 01/07 of a year to 30/06/ of next year. In your case for 7/08 to 6/09; and 7/09 to 6/10 your service 3.5 months only each year. Hence No increment for both the years. Your office is correct.

    1) I am a ICAR class I scientist in the entry cadre of Class I scale.I have been denied promotion & this is 11 th year in the same post. Our promotions are governed by ACR, Research output, publication of paper etc. I read some where that group A post, under organised sector ,will not be covered under MCAP scheme. So if I goto CAT any chance of inclusion of ICAR group A employees of under the umbrella of MCAP scheme and get that benefit?

  42. I am a fresh recruitment and, I residing in bangalore, which is my head quarter. My parents depand on me but they not residing with me, they residing in my home town.Can my parent entitle to avail HTLTC for the year 2010.from home town to bangalore and Back.As per Swamy’s CCS LTC Rules(C-11)2010 in page 14 ponit 3To home / declared destination and back.- ” In every case , the journey should be to the hometown / declared destination and back, but it need not necessaryily commence from or end at the headquarters of the Goverment servant either in his own case or in the case of the family. But the assistance admissible will be the amount admissible for the actual distance travelled, limited to the amount that would have been admissible had the journey been performed between the headqurters and the ‘home’ of the Goverment servent or declared destination, Rule7,GID(1). And the page no 3 II.Definitions of family ” Parents and /or step-parents (Stepmother and stepfather) wholly dependent on the Goverment servent irrespective of whether residing with the Goverment servent or not. In the above facts please clerify my case whether my parents entitled or not to avail the HTLTC for the year 2010.

  43. Kindly let me know, if an Govt. Servant was already in Grade Pay of Rs.1,900/- (pre-revised scale of Rs.3,050-75-3,950-80-4,590). After completion of 10 years of service on March 2010, what will be the next eligible Grade Pay that could be granted under ACP and MACP Scheme?

  44. I had submitted medical claims in connection with the treatment of m husband in recognised/govt. hospitals. But since the office were keeping the claims pending I filed an OA in CAT and most of my bills were paid. Now I have 5 more claims to be reimbursed. The claims pertain to the period 2004 -05. The authorities during that time have put it in record (even while enquired through RTI act) that the claims are paid. But they have given false information and the bills are still lying with the office. The new authorities find it a headache to rectify matters. What do i do to bring out the irrationality of the ex officers and get reimbursement?

  47. Request for clarification of the anomaly in fixing of my Pay at the time of my Assessment Promotion to the post of Senior Technical Officer from Assistant Engineer.
    I was promoted as a “Senior Technical Officer” with effect from 05.10.2005. Accordingly, the Basic Pay in the pre-revised Scale of Rs 8,000-275-13,500 has been fixed at Rs 8825/-.
    The implementation of Sixth Pay Commission pay scales will come into effect from 01-01-2006 and hence my basic pay has to be fixed at the appropriate level corresponding to Rs 8,825/-. Now my basic has been fixed at Rs 9,100/- in PB-II. However, the fixation of my Basic in the sixth pay commission should have been in the PB-III (Rs 15,600-39,100 with Grade Pay Rs 5,400).
    The scale of pay for Senior Technical Officer (Which I am presently holding) is Rs 15,600-39,100. I am sure that there has been some error in fixing of my pay, which I would like to request the experts to clarify please.

  48. An official is getting 4200GP. He transferred to another Department in the same Grade Pay. Later on his Grade Pay increased to 4600 in his Parent Department. In this case will he repatriate to his Parent Department? As no one can be deputed to lower grade, Please guide in the matter.

    Suggestion:

    20 per cent and 30 per cent Tax on Income are not advisable, as higher income groups may consider it painful to pay high taxes and there are chances that they may opt to evade taxes in one way or the other.

    Well, Income Tax may be considered to be charged at a single flat rate of 10 per cent on total Gross Income as TDS just like a Service Tax only, the minimum.

    However, this 10 per cent Income Tax amount on total gross income may be borne by Employer and Employee in the following ratio and amount:

    The implementation of the above System of bearing the tax burden both by the Employer and Employees may be considered as an effective tool for reducing the tax liability on employees (individuals) and reduces the chances of evasion of Tax by Employers, as sometimes, employers show inflated/bogus/more salaries in their accounts to reflect less income or profits.

    Moreover, Government may consider reduced/lower single slab Income Tax rates i.e. 2 per cent, 4 per cent, 6 per cent and 8 per cent on Total Gross Income upto Rs.50,000, Rs.1,00,000, Rs.1,50,000, Rs.2,00,000 respectively, in the form of TDS for lower income groups, which is to be wholly borne by the Employer, instead of Employee.

    However, people below the poverty line may be given exemption of this 10 per cent Tax.

    Incomes of All small firms, different businessmen, wholesalers, retailers, Actors, Musicians, etc. may be considered to be charged at a single flat rate of 10 per cent either it is 25 lacs or 50 lacs or more.

    Spiritual organizations, Charitable Institutions, Clubs, Welfare Organizations etc. may be considered to be liable to Pay Tax at a single flat rate of 10 per cent on all incomes/donations/receipts.

    Incomes from 1. Interest 2. Dividends 3. Short / Long Capital Gain 4. House Property may be considered to be charged at a single flat rate of 10 per cent as TDS just like a Service Tax. However, people below the poverty line may be given exemption of this 10 per cent Tax.

    Initially, Income Tax of single flat rate of 10 per cent on total Gross Income as TDS may be considered to be applicable for employees of Government, Public Sector Undertakings and Public Limited Companies. Its scope may be further extended to Private Limited Companies, then small firms, then different businessmen, then wholesalers, then retailers and so on.

    Wealth Tax may be considered to be abolished.

    STT may be considered to be allowed to be continued and may not be considered to abolish the same.

    One new Tax on trading of Shares in the Stock Market may be introduced i.e. 0.001% on delivery and 0.0001% intra-day, which will go into the pockets of individual companies, whose shares have been transacted or traded, proportionately according to their volume of transactions.

    When all the incomes are charged at a single flat rate of 10 per cent, then ultimately, the revenue from Income Tax shall definitely be manifold. Then there are chances of less Tax evasion, less burden of filing returns.

    All investments and purchases should be free from any compulsion in liberalized economy and as such, all Tax Saving Investment Schemes may be considered to be abolished. People should decide its own priorities for purchases and investments with 90 per cent amount available at its disposal – after paying 10 per cent Income Tax. Then People shall have the option either to invest the savings or purchase some more items/things out of the savings. In both the cases, the Government will earn revenue either in the form of Tax on interests/Dividends or Tax on Excise/Sales Tax.

    The implementation of this single flat rate of 10 per cent Tax on Total Gross Income may be considered to be an effective tool for overcoming recession and will definitively increase production, employment opportunities and investments, in addition to reduction of black-money, un-accounted income and tax evasion.

    With due respect, I would like to draw your kind attention for consideration of provision of 0.001% Company Share Transaction Tax (CSTT) payable by buyer/seller on each transaction of shares, which will go into the pockets of respective individual Company/PSU, whose shares have been transacted in the Stock Market..

    In the Stock Market, every body is getting its return/shares, except the respective individual Company/PSU, whose shares have been transacted, such as :-

    1. Government STT, ST + Tax on Capital Gain, etc.
    2. Brokers, Sub-Brokers, Agents, dealers etc. Brokerage, Accounts Maintenance Charges
    3. Buyers and Sellers Profit +/- Loss
    4. Employees of Stock Market, Brokers etc. Salary, Commission etc.
    5. Respective Individual Company/PSU itself
    Whose shares have been transacted
    in the Stock Market
    “Zero” and “0”

    0.001% Company Share Transaction Tax (CSTT) amount, so collected/received by the respective individual Company/PSU, may be used for:

    1. Development of infrastructure and Growth of its Company/PSU (including payment of Dividends to shareholders etc.)
    2. Which may result in the development of Indian Economy, as a whole
    3. this may accentuate the expansion of Indian Stock Market
    4. And once again, it may boost the Growth of the Companies
    5. And it may lead to perpetual repetition of this growth cycle

    Government, Ministry of Finance and SEBI, if think appropriate, may take up this matter with all concerned and consider the following or any other suitable CSTT rates, in the interest of the growth of the Companies, development of Indian Economy and expansion of Stock Market, as a whole.

    It is also suggested to consider a single flat slab of 10% Tax on all Capital Gains chargeable as TDS, which may be deducted by the Brokers on quarterly/yearly basis, so that :-

    2. Government may get the direct revenue/Tax on the Capital Gains, uninterruptedly.

  52. I had been appointed as LDC on direct appointment on 26.12.1995. My 1st ACP was due on 25.12.2007 but has not been granted by the KVS by giving the remarks “Not Eligible

    As per DOPT letter LDC with eight year of regular service is eligible for Promotion/ACP but I had rendered more than 15 year of service. It is humbly submitted to help me as guide in the matter.

  53. Respected Sir/ Madam,

    I want to draw some discrimanary about seniority and promotion at the stage of ldc to UDC.
    1. DOP&T has rule dated 15.1.2008-CS-II section that stop gap arrangement. This rules has you have qualifying service/ approved service minimum 8 years. Then DOP&T give promotion LDC to UDC. But all the departments/Ministrieis have several cases pending in administation section of various departments did not make elegible LDC to UDC while they have completed approved service.

    2. Accordingly MACP when you completed 10 year regular service. They give to ldc to MACP in the grade pay of 2000 Rs.. This is the only 100 Rs. increase. This is the grade pay like increasing is big anomaly. when A ldc completed 10 year service, why he is entitled for 2000 GP. why not entitled 2400Rs. GP.

    3. If cadre have no vacancy in the financial year then no promotion will met to ldc to udc. Wait for one year later. All arrears waste for mercyful ldc, who is also poor.

    4. Date of next increment is july month. which is not right. Thousand employees are such so which take increment in january and february before 6th CPC. But now they are taking july increment. They are bearing 6 month incremanet loss.

    Why govenemnt is not taking proper action about on MACP and approved service. When employees is entitled for promotion why promotion did not meet on time when employee is entitle for this.

    Kindly motives question send to concerned authority DOPT and Anomily committee.

  54. I am a ldc of Department of Agriculture and Cooeration. My select list is 2002, Date of appointment 13.01.2003. In my department have 1999 select list ldc are still now ldcs. when stop gap arrangment OM dated 15.1.2008 by dopt. which is not implement still now in DOAC. Are they not entitled for promotion when they have completed 12 year service in the grade of ldcs. My department says that we have no vacancy in calender year. What we can do. Policy make by DOPT. Dopt has given surplus udcs to us. We are making efforts for promotion but DOAC’s employees still now ldcs. Can anybody this grievance reaching to DOPT and anomaly committee.

  64. I think it is under 80CCD(2) and amended 80 CCE to exclude contribution by central govt. under 80 CCD(2)

    1. Yes. the contributions made by your employer towards your NPS account qualifies for deduction under Section 80CCD(2) without attracting the limit of Rs. One lac laid down in Section 80 CCE from the current financial year. However there is only one restriction that only up to 10% of your salary only qualifies for deduction without any monetary limit.

    Presently I am working as ASSISTANT (with entry
    GP Rs.4200) since 1984 and getting salary with GP Rs.4600 after granting
    Ist ACP/MACP but my Deptt. ie. Kendriya Vidyalaya Sangathan (HQ) New Delhi deny
    to grant IInd MACP in the GP Rs.4800 with the reason that I refused vacancy
    based promotion during 2003 and declared debar for promotion till 31.07.2008.

    In this context I want
    to say that my debar period has been completed on 31.07.2008 and a DPC of
    Assistant to Section Officer has also been conducted in March/April 2009 after
    completion of my debar period and promoted two Assistants to Section Officer
    who are junior to me. I submitted representation many time but there is no
    reply from my Deptt.

    PLEASE CLARIFY WHETHER THE INTERPRETATION
