Clarification regarding reservation in promotion to PwBDs: Railway Board Order RBE No. 123/2023 in consultation with DOPT clarifies seniority among PwBDs will be counted from the date of certification of his/her disability

Sub: Clarification regarding reservation in promotion to PwBDs.

Ref: Southern Railway’s letter No. P(S)524/XII.MIN/Up. Of PS/PB.PER Unit dated 24.08.2023.

One of the Zonal Railway namely SR had sought clarification on the following points:-

a) If 02 employees of same category disability are available in the feeder cadre, whether the cadre seniority or the seniority amongst PwBDs as stated in Para 4.2 of DoPT OM has to be considered while filling up the point reserved for PwBDs for grant of promotion

b) Whether the above provision of Para 4.2 of the OM will be applicable at the time of entry into the particular grade of the cadre for counting of the seniority amongst PwBDs or in every subsequent promotion to next higher grades.

2. The matter has been examined in consultation with DOP&T. In this regard it is stated that Para 4.2 of O.M. issued by DoPT dated 17.05.2022 clearly provides that:

“4.2 An employee who acquires disability, after entering into service, will be entitled to get the benefit of reservation in promotion as a PwBD. However, his seniority among PwBDs will be counted from the date of certification of his/her disability, i.e., disability of 40% or more in the categories covered under Section 34(1) of the Rights of Persons with Disabilities Act, 2016.”
