Posting of husband and wife at the same station

This is an import government orders for the employee whose spouse is also working in a government Services.  Government has made its intentions clear.  It’s committed to increase the representation of women in central government jobs.

It has been decided that when both spouses are in same Central Service or working in same Deptt. and if posts are available, it is  mandatory to them at the same station.

The consolidated guidelines are as follows:-

  • Where the spouses belong to the same All India Service or two of the All India Services, namey IAS, IPS and Indian Forest Service (Group ‘A’) the spouse may be transferred to the same cadre by providing for a cadre transfer of one spouse to the Cadre of the other spouse, on the request of the member of service subject to the member of service not being posted under this process to his/her home cadre. Postings within the Cadre will, of course, fall within the purview of the State Govt.
  • Where one spouse belongs to one of the All India Services and the other spouse belongs’ to one of the Central Services, the cadre controlling authority of the Central Service may post the officer to the station or if there is no post in that station, to the State where the other spouse belonging to the All India service is posted.
  • Where the spouses belong to the same Central Service, the Cadre controlling authority may post the spouses to the same station.
  • Where the spouse belongs to one Central Service and the other spouse belongs to another Central Service, the spouse with the longer service at a station may apply to his/her appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station to the nearest station where the post exists. In case that authority, after consideration of the request, is not in a position to accede to the request, on the basis of non-availability of vacant post, the spouse with lesser service may apply to the appropriate cadre authority accordingly, and that authority will consider such requests for posting the said officer to the station or if there is no post in that station to the nearest station where the post exists.
  • Where one spouse belongs to an All India Service and the other spouse belongs to a Public Sector Undertaking, the spouse employed under the Public Sector Undertaking may apply to the competent authority and said authority may post the said officer to the station, or if there is no post under the PSU in that station, to the State where the other spouse is posted.
  • Where one spouse belongs to a Central Service and the other spouse belongs to a PSU, the spouse employed under the PSU ‘may apply to the competent authority and the said authority may post the officer to the station or if there is no post under the PSU in that station, to the station nearest to the station where the other spouse is posted. If, however, the request cannot be granted because the PSU has no post in the said station, then the spouse belonging to the Central Service may apply to the appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station, to the station nearest to the station where the spouse employed under PSU is posted.
  • Where one spouse is employed under the Central Govt. and the other spouse is employed under the state Govt, the spouse employed under the Central Govt. may apply to the competent authority and the competent authority may post the said officer to the station or if there is no post in that station to the State where the other spouse is posted.
  • The husband & wife, if working in the same Department and if the required level of post is available, should invariably be posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age. This will not apply on appointment under the central Staffing Scheme. Where only wife is a Govt. servant, the above concessions would be applicable to the Govt. servant.

It was also directed by DOPT that the cadre controlling authority should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefore, may be communicated to the employee.

  1. The circular on spouse ground issued in sept,2009 has to be extended to all categories of employees in Gr.A,B, C &D cadres.At least some depts are interpreting it to be applicable only for Gr.A central services like IFS,IPS etc referred therein.
    If the intention of DOPT is to allow transfers at lower levels also, it should take into account the issues on seniority, etc since the lower B,C,d posts seniority is regionwise .Thus transfers will involve seniority disputes and complications.The DOPT must be aware where this OM has been agitated in CAT etc for and against the claims.
    If transfer is allowed to join spouse, the claim of seniority need not be protected to avoid complications.If seniority is to be allowed ,the recepient cadres may start litigations -never ending- defeating the very purpose and intention of the new policy.

  2. why only spouses from government sector is considered for this benefit. if one of the spouse is a private servant and a place of posting is available for the other spouse then why that benefit is not passed to that couple ?
    central government is supposed to be equal to all the citizens irrespective of his job in cg or pvt. organisation.

    1. I agree with Mr. Vinod that why only spouses from government sector is considered for this benefit. This is the exact case with us. I am working in private sector and my wife is CG employee for past 15 years. we are trying for her transfer, but facing many problems. our daughter is only 8 years old and needs both the parents. there is also a condition that my wife has to loose 15 years of seniority if she gets transferred ?? I think Govt. must think about this. After 15 years of service i.e. one has to loose half of his/her job life for the sake of transfer. We are staying in India, and Central Govt. captures whole of India then why this condition ??

  3. GConnect has taken up an old DoPT OM dated 30/09/2009 to review/consolidate a topic. Govt has already been taking initiative in the matter. But posting of husband and wife at the same station SHOULD NOT be at the cost of Single Male Employee whose wife is a homemaker. Such homemaker do bring up the children in a better manner with lesser income at disposal.

  4. Every issue has two ways to look at it. For example, on my promotion i am liable for minimum two years of service anywhere in India and with my wife working in pvt orgn, i will definitely be separated from my family for few years. Considering the fact that only particular group of officers (commercial audit) are having this all india transfer liability, it looks harsh. On the other side of the coin, administratively speaking, i was aware of this exclusive liability at the time of joining the service itself, which means one should never complain.

  5. Gentlemen, please be aware that the requirement of posting of husband and wife in the same station is not only for biological but also to keep the family culture of our society above. It is believed and proved in many civilised societies that the crime rate would come down when human live in families in comparison with those who live away from families. Even the corruption rate with those with families is less according to one statistics. I have seen in Tamil Nadu in early days, the family photograh of the Driver is pasted in front of the driver so that he would not venture for a high speed. Hence, the home maker theory should not disturb the present provision given by the Government. As far as the private sector spouse is concerned, it is believed that the spouse in private sector has the option to shift to another employment as his superannuation benefits would not be affected by change of employer since it is managed by other bodies like EPF, ESI etc., which is not the case with Government employees.

  6. dopt has made a provision but is it carried out in letter and spirit?

    i am a central govt employee with 8 years of service and wife is also a central govt. employee with 7 years of service, but in different organisation. we have been trying hard for posting at same station for the past 2 years but to no avail. it is being turned down on one or the other pretext, beside this we have a baby of 7 months ..which makes our life more difficult……. please suggest what to do?

  7. In the case only the wife is a Govt Servant, and husband is engaged with Private industry, In my humble opinion, the above order clearly states that wife should be allowed to get a transfer to the station of husband…

If both spouse are govt employee,there are some restriction for their allownces like hra,medical allownce,education allownce and ltc.Such restriction is not applicable if one of the couple is in private service or managing private property.If one of the couple was alloted accomodation by a PSU his/her spouse working in govt service in same station will not get HRA and viceversa.Now PSU employees have to pay incometax for their accomodation.If the allotee is transfered,the spouse and dependents have to vacate the accomodation eventhough he/she has been deprived a big amount as hra.Some state govts not giving hra to both eventhough both of them are in different station and even different states.Working couples have to sacrifice their personnel life for some extent even outsiders they are “double income group”.considering above facts, spouses working in govt services to be posted in same station and some of the outdated rules to be changed

Sir, I am an employee of Dept of Posts. working at Ranchi my wife is also working in the same dept. and posted at Kolkata.On promotion in the year 2009 i am posted at Ranchi willingly because in that time there are no vacancy in my cadre at west bengal.Now there are some vacancy in my cadre at Kolkata .I am represent for my transfer to my wife place of posting as per new DOPT order but, dept. replied that though there is vacancy at Kolkata , my request now not consider because in2009 you opted for Jharkhand circle .So, as per dept. rule u have to work for 3 yrs at Jharkhand -as per dept. replied.Now, my question is in 2009 i have no other option to eccept my promotion, but now as there are vacancy at west bengal why DOPT order not applied on me , i have a son for 7 yrs who’s health and education is badly affected.Pl guide me accordingly.

Kedriya vidyalaya sangathan has issued a circular No F.1-1/2006-07/KVS(HQ)/Estt.II dated 14/05/2010 regarding posting with spouse which is totally against the letter and spirit of the circular of DOPT OM F.NO.28034/9/2009-Estt.(A) dated 30.09.2009 about Posting with Spouse. The KVS circular makes condition that the spouse should be posted within 100 Kms. They have not published the above circular any where in their website for public access. I got it through an RTI application. Can i do anything?

  14. I am a Gr.A officer in Karnataka under Ministry of Finance and my wife is employed in Government University in Tamil Nadu which is a non transferable post….can i get transfer to tamil nadu and what are the implications on me getting the transfer such as seniority, etc…pls advise

    1. In your case it appears that you are entitled for transfer to Tamilnadu. But transfer on spouse grounds will not ensure seniority. Normally, If both places come under the same promotional zone, seniority will be ensured.

  16. i m working in NTPC (PSU) as Manager (HR) presently posted at Badarpur and my spouse is working for another PSU posted in MP, is there any provision/ policy for us so that we can be stationed at same place. please suggest

  24. I am a central govt employee from last three years in patna, bihar. But my husband is in pvt sector in delhi. Can i get my transfer where my husband is working???plz help me with the correct ans.
