Sir/Madam,

Please find enclosed herewith a copy of the order of the Hon’ble High Court of Delhi in WP No. 831 of 2022 (Vichitra Prestressed Concrete Udhyog Pvt. Ltd. & Ors Vs Central Board of Trustees EPF & Ors) in which the Hon’ble High Court noted adversely the uploading of incorrect order on “e-proceedings portal” and directed to ensure that the orders which are passed in future are uploaded in a proper manner as per direction passed vide order dated 4th December 2020 in WP (C) No. 9530/2020 titled M/s. Civicon Engineering Contracting India Pvt. Ltd Vs. Central Board of Trustees & Ors. The said order is enclosed herewith.

2. It is pertinent to mention that detailed instructions had been issued to the Field Offices vide HO Letter No. C-I/3(28)2016/7A & 14B/1189 dated 19.01.2021 (copy enclosed) to adhere to the directions issued by the said judgement. However, all steps from issuing notice to uploading orders in e-proceeding portal mentioned in the stated circular are not being strictly followed. This has resulted in adverse observations in the aforesaid orders by the Hon’ble High Courts.

3. In light of the aforesaid directions of High Courts and extant instructions of Head Office, it is hereby directed to comply with the said judgement diligently. Further, all Zonal ACCs may ensure compliance of the HO instructions by reviewing the same in O & M meetings every month. Any further adverse remark of any court would be viewed seriously.
