Transport Allowance for employees posted at Faridabad, Ghaziabad, Gurgaon and Noida – clarification

Department of Posts confirms payment of transport allowance to central government employees posted in offices located at Faridabad, Ghaziabad, Gurgaon and Noida as per rates applicable to ‘Other Places’

As per Ministry of Finance clarification Central Government Employees working at Faridabad, Ghaziabad, Gurgaon and Noida are entitled to Transport Allowance which is applicable to Other Places Category.

Sub : Payment of Transport Allowance to Central Government Employees posted in offices located at Faridabad, Ghaziabad, Gurgaon and Noida – Ministry of Finance, Department of Expenditure’s OM. No.21(8)/2010-E.II(B) dated 26.10.2015, issued in compliance of Order dated 18.03.2015 of Hon’ble CAT, Principal Bench, New Delhi, in O.A.No.996/2014 of Anil Chopra & Ors and 50 OAs (clubbed together).

The undersigned is directed to refer to Ministry of Finance, Department of Expenditure’s O.M No.21(8)/2010-E.II (B) dated 30.10.2015 on the subject cited above.  It is to say that that Ministry has issued comments/instructions/decision vide their O.M.No.21(8)/2010-E.II (B) dated 26.10.2015 in compliance of ORDER dated 18.03.2015 of Hon’ble Central Administrative Tribunal, Principal Bench, New Delhi in O.A. No.996/2014 of Anil Chopra & others and 50 OAs (clubbed together).  These OA Nos. are (i) 1351/2014, (ii) 1681/2014,(iii) 1764/2014, (iv) 1868/2014, (v) 2539/2014, (vi) 3681/2014, (vii) 2107/2014 and (viii) 3831/2014 in common order had been filed by the employees under administrative control of Department of Posts.  The Ministry of Finance, Department of Expenditure has, thus, requested to bring their O.M.No.21(8)/2014-E.II (B) dated 26.10.2015 to the notice of all the employees concerned.

2. As per the instructions contained in Ministry of Finance, Department of Expenditure’s O.M.No.21(8)/2014-E.II (B) dated 26.10.2015 in the matter which provides that :-

“Now, therefore, having considered all the relevant factors and as decided at level of Hon’ble Finance Minister (Since consideration of the matter at the level of Finance Minister has also been decided by the Hon’ble Tribunal) that there are no compelling grounds/justification for considering the demands of the employees posted in offices located at Faridabad, Ghaziabad (till 31.03.2015), Gurgaon and Noida to allow Transport Allowance at rates applicable for Delhi viz. A-1/A class Cities under O.M dated 29.08.2008 grant of Transport Allowance, Faridabad, Ghaziabad (till 31.03.2015), Gurgaon and Noida would continue to be governed by rates prescribed for ‘Other Place’ as per O.M dated 29.08.2008 read with O.M. 06.09.2015.

Thus, Transport Allowance to Central Government Employees posted in Offices located at Faridabad, Ghaziabad (till 31.03.2015), Gurgaon and Noida has to be regulated as per rates applicable to ‘Other Places’ in terms of Ministry of Finance O.M.NO.21(2)/2008-E.II(B) dated 29.08.2008 and subsequent O.M.No.21(1)/2015-E.II (B) dated 6.8.2015″.
