Pay fixation after promotion and after MACP

Question

I got appointed as Tech. Asstt. / Assistant in the Level 6 of VII Pay Commission on 9th June, 1983.

I got the first promotion in the Level 6 of VII Pay Commission with effect from 3rd November, 1988.

As per Annexure – I, para.5 of O.M. No. 35034/3/2008-Estt. (D) dated 19-05-2009 of DOPT, promotions / financial upgradation granted under ACP to the pre-revised scale of Rs. 5,000 – 8,000 and Rs. 5,500 – 9,000 prior to 01-01-2006 will be ignored on account of merger of pre-revised scale of Rs. 5,000 – 8,000, Rs. 5,500 – 9,000 and Rs. 6,500 – 10,500 recommended by the Sixth CPC.

I got the first promotion in the Level 7 of VII Pay Commission with effect from 23rd March, 2003.

I was granted the 2nd MACP after completion of 20 years of regular service in the Level 8 of VII Pay Commission with effect from 01/09/2008.

I was granted 3rd MACP after completion of 30 years of regular service in the Level 9 (Group B) of VII Pay Commission with effect from 09.06.2013.

Now I am likely to get the Second Promotion in the LEVEL-10 (Group A) in the promotional hierarchy.

Can I get the benefit of Pay Fixation (one increment) as promotion from Group B to Group A post or only placed in the next higher cell of LEVEL-10 (Group A).

  1. As per the ACP/MACP Rules he has got the first promotion within 8 years on 3/11/1988, so he is does not comes under 1st ACP, next MACP started from 1/9/2008 within this period he got the 2nd promotion on 23/3/2003, so he is already got 2nd promotion, he does not comes under MACP MACP
    rules comes from 1/9/2008 to 2018 of next10 year only not from his joining service. He has also got 3rd MACP on 9/6/2013. In this case his office has not followed proper promotion rules, so further pay fixation after promotion & MACP is does not arise as per the rules as attached. Before is retirement of his period so for given given extra amount will be recovered from him. He is only eligible as per the 7th CPC matrix levels 6 to 8 i.e. in GP as 6th CPC tables of his basic pay plus Rs.4200, 4600 & 4800 only. Further to inform after the 6th CPC there will be no monitory benefits for promotions and there is no pay scales for designations, only pay benefits as completion 12 years in ACP and of every 10 years of service as MACP from 1/9/2008.

  4. I joined on 01.05.1998 in the pay scale 4000-100-6000 as steno typist. I completed 10 years of service on 01.05 2008 but as the MACP effective from 1.9.2008 so I got 1st MACP w.e.f. 1.9.2008. Then I got NFSG w.e.f. 8.2.13 in Grade Pay 4200. Finally promoted as Jr. Steno in the same grade pay 4600 with no increment benefit as got
    in NFSG. Now I have completed 20 yrs of service on 1.5.2018. Will I get 2nd MACP. Please advise as my deptt. is saying not eligible.

    • Your office has done is correct. After 1st MACP you got 2 upgradations so it’s correct. From the 6th CPC there’s no pay scales only upgradations by way of next grade pay changes on promotions. From 1/9/2008 given MACP those who are not got Promotion between that 10 years. In the MACP only given 2 increments in old matrix level and fixed at next level of table in 7th CPC.

  6. Whether a KVS emplyoee is eligible for a benefit of pay matrix under ACP increment or not if he/she completed 12 years in Level 7.
