Supreme Court suspends NEET 2013 Medical Entrance Exam – Notification issued by Medical Council of India for conducting entrance for admissions to MBBS, BDS quashed
Even as admissions to MBBS and BDS Seats through NEET 2013 Medical Entrance Exam are almost over, Hon’ble Supreme Court of India quashed the Medical Council of India’s (MCI) notification for holding common entance tests for MBBS, BDS and post-graduate medical courses.
This was a 3 member bench decision which had goen in favour of Private Medical Institutions with two of three members held that the notification of Medical Council of India to conduct All India Medical Entrance Examination which is popularly known as NEET was ultra vires of the Constitution.
Admisssions to MBBS and BDS already made through NEET not to be affected
The apex court, however, made it clear that its verdict will not affect the admissions which have already taken place.
While the majority decision of Chief Justice of India Altamas Kabir and Justice Vikramajit Sen was that MCI was not empowered to prescribe all India medical entrance tests, Justice A R Dave held that Holding of National Eligibility Entrance Test (NEET) is legal, practical and is the need of the society and that he is dissenting with the view of other two members of the bench
As per the majority verdict the MCI notification was in violation of Articles 19, 25, 26, 29 and 30 of the Constitution.
Earlier 115 Petitions were filed in Hon’ble Supreme Court challenging MCI Notification for conducting NEET to admit students in MBBS and BDS courses in medical Colleges throughout India, which have been decided now by Apex Court in favour of applicants.
