Effect of Classification of Posts under CCS (CCA) Rules, 1965

I have analyzed as to why the financial up gradation within the Group B after four years of service cannot be considered as promotion or MACP/ACP.  Now, I would like to share more thoughts in the same subject.

As per Office Memoranduam issued vide S.O.946(E) dated 9th April, 2009 of Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training). (Click here to read this Office Memoranduam dated 09.04.2009), Group-B posts are defined as follows.

“A Central Civil post carrying the following grade pays:-
Rs.5400, Rs.4800, Rs.4600 and Rs.4200 in the scale of pay of Rs.9300-34800 in Pay Band-2

From the above Office Memorandum dated 9.4.2009, it could be seen that both the grade pays viz., entry grade pay of PB-2 Rs.4800/- that is applicable for Section Officer, Superintendent (Posts), Income Tax Officers/ Superintendent, Appraisers Etc (Customs and Central Excise) and non-functional upgraded grade pay of PB-2 5400 after completion of 4 years of service are coming under the Category of Group B.

Consequently,  DOPT’s clarification in the letter Ref.No: 10067/2010 dated 29.11.2010 (Click here to read this Office Memoranduam dated 29.11.2010) to the effect that up-grdation to grade pay of Rs.5400 in PB-2 will not be counted as financial upgradation, if it is not a grade pay applicable for promotional Post, would exactly applies to this scenario.

As a result, Officers in the Group B Posts tabulated below, should be given the grade pay of Rs.5400 in PB-2 with effect from 1.1.2006, if they had completed 4 years of service on the said date and on getting 2nd ACP prior to 1.9.2008, the officers are required to be given the non-functional up-gradation from Group B Post to Group-A post that carries the grade pay of Rs.5400 in PB-3.
