Child Care Leave – Frequently Asked Questions

[Q] Who are entitled for Child Care Leave?

[A] Child Care Leave can be granted to women employees having minor children below the age of 18 years, for a maximum period of 2 years (i.e. 730 days) during their entire service, for taking care of up to two children whether for rearing or to look after any of their needs like examination, sickness etc. Child Care Leave shall not be admissible if the child is eighteen years of age or older.

[Q] Am I eligible to draw Salary for the period for which Child Care leave is availed?

[A] During the period of such leave, the women employees shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.

[Q] Whether CCL can be debited against any other type of Leave admissible to the employee?

[A] Child Care Leave shall not be debited against the leave account. Child Care Leave may also be allowed for the third year as leave not due (without production of medical certificate).

[Q] Whether Child Care Leave can be combined with any other leave?

[A] It may be combined with leave of the kind due and admissible.

[Q] Whether Child Care Leave is applicable for third child?

[A] :- No. CCL is not applicable to third Child.

[Q] How to maintain Child Care Leave account?

[A] The leave account for child care leave shall be maintained in the proforma prescribed by Govt, and it shall be kept alongwith the Service Book of the Government servant concerned.

[Q] Whether CCL can be claimed as a matter of right?

[A] The intention of the Pay Commission in recommending Child Care Leave for women employees was to facilitate women employees to take care of their children at the time of need. However, this does not mean that CCL should disrupt the functioning of Central Government offices. The nature of this leave was envisaged to be the same as that of earned leave.

[Q] Whether we can prefix or suffix Saturdays, Sundays, and Gazetted holidays?

[A] As in the case of Earned Leave, we can prefix or suffix Saturdays, Sundays, and Gazetted holidays with the Child Care Leave.

[Q] Should we have any Earned Leave in Credit for the purpose of taking Child Care Leave?

[A] There was a condition envisaged in the Office Memorandum relavant to Child Care Leave to the effect that CCL can be availed only if the employee concerned has no Earned Leave at her credit. However, this condition was withdrawn by the Government and as such there is no need for having EL in credit to avail CCL.

[Q] Whether CCL can be availed without prior sanction?

[A] Under no circumstances can any employee proceed on CCL without prior approval of the Leave sanctioning authority.

[Q] Can we avail CCL for the children who are not dependents?

[A] The Child Care Leave would be permitted only if the child is dependent on the Government servant.

[Q] Is there any other conditons apart from the total number of holidays and the age of the child?

[A] The Conditions regarding spell of CCL, imposed upon by the Government are that it may not be granted in more than 3 spells in a calendar year and that CCL may not be granted for less than 15 days.

Further, CCL should not ordinarily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority is fully satisfied about the need of Child Care Leave to the probationer. It may also be ensured that the period for which this leave is sanctioned during probation is minimal.

[Q] Whether Earned Leave availed for any purpose can be converted into Child Care Leave? How should applications where the purpose of availing leave has been indicated as ‘Urgent Work’ but the applicant claims to have utilized the leave for taking care of the needs of the child, be treated?

[A] Child Care Leave is sanctioned to women employees having minor children, for rearing or for looking after their needs like examination, sickness etc. Hence Earned Leabe availed specifically for this purpose only should be converted.

[Q] Whether all Earned Leave availed irrespective of ‘number of days i.e. less than 15 days, and number of spells can be converted? In cases where the CCL spills over to the next year :for example 30 days CCL from 27th December, whether the Leave should be treated as one spell or two spells’?

[A] No. As the instructions contained in thc OM dared 7.9.2010 has been given retrospective effect, all the conditions specified in the OM would have to be fulfilled for conversion of the Earned Leave into Child Care Leave. In cases where the leave spills over to thc next year, it may be treated as one spell against the year in which the leave commences.

[Q] Whether those who have availed Child Care Leave for more than 3 spells with less than 15 days can avail further Child C31.e Leave for the remaining period of the current year’?

[A] No. As per the OM of even number dated 7.9.2010, Child Care Leave may not be granted in more than 3 spells. Hence CCL may not be allowed more than 3 times irrespective of the number of days or times Child Care Leave has been availed earlier.

[Q] Whether LTC can be availed during Child Care Leave?

[A] LTC cannot be availed during Child Care Lcave as Child Care Leave is granted for the specific purpose of taking care of a minor child for rearing or for looking after any other needs of the child during examination, sickness etc.

[Q] Whether Child Care Leave is applicable to All India Services?

[A] Yes. Child Care Leave is applicable to employees under All India Services.

  1. can retired central govt.after superanuation engaged against regular work/post if yes under which rule and what should be age limit.

  4. My daughter is in class 12th. She is appearing for cbse board examination and also preparing for various entrance examination. I applied for child care leave to look after my child as she is under lot of stress and mental pressure but every time i was refused leave on the pretext that child is medically fit so leave cant be granted.Is it right? Can it be rerused like this? What shoud be my further course of action ? Please advice me.More over she is my single girl child.

    1. There is no link between child’s health and child care leave. You can represent your case with the higher authorities in your department or you can move CAT to get justice if the authority specifically deny by give it in writing the reason quoted by you

  5. My wife is working in State Bank of India and CCL facility is not provided in banks. In my office, whose children are studing in 10th or 12th classes, All ladies have gone to CCL for2-3 months. My elder son is also going to appear for 12th class exams and younger son for10th class. Please clarify Why I sould not get CCL, if my wife is not eligible for this??? This may kindly be treated as most urgent.

    I am working in Central Government office and my wife is working in state bank of india. CCL facility is not available in Banks. My elder son is appearing in 12th Borad examination and younger son is appearing in 10th class exams in coming March, 1012. As my wife is not eligible to avail CCL, Can I avail the CCL for my sons? In my office all ladies have gone on CCL for 2-3 months, whose children are in 10th or 12th class. This may kindly be treated as most urgent. Regards.

      1. Sir, thanks for the reply. I know that male employees are not covered in it. In all the facilities provided by the government, only one (either husband or wife) can avail. Why not here, when my wife is not entitled for CCL in SBI. And my children are very much required our presence during the board examinations. Sir, please tell me, is not it clear injustice with us?? Govt. must review or amend it in ccl facility.

    1. CCL is based on the age of child. Apart from administrative regulations, CCL will be applicable till the first two children attain age of 18

  9. Govt. must amend the rules of ccl. we the govt employee are getting CEA up to passing class xii than why not ccl?

Is this circular ok. ye kese logon ne mil kar ccl ka majak bana diyahai. some qn in my mind…..1) if during in ccl, child is ok in 3or4days then what i do in leave10to12dats. 2) kya child 1 saal main 3 se jyada bar ill nahi ho sakta.if they have 2 child then what he dose. 3) kya ccl ka child ke exams se koi link nahi.kam se kam 2 time in a year it is required. 4) kya those who have 200-300EL in acctt,why ccl given to them.because of some these type of qns some eligible,s not sanctioned the ccl.kya spell of ccl jyada nahi required,kya period of cc minimum 5 day is not sufficiant.please do the work on these type of requirements thanks.

  12. my son is studying in U.S and staying with his father. can I avail CCL and visit U.S to take care of my son

    1. If your son is not more than 18 years old and you are otherwise eligible for CCL, there is no bar to take care of your child who is abroad

  13. one of my staff was appointed on compassionate grounds. She is now remarried and has got three children from her second husband and one her own child. can she claim CCL for her own child as hers child would be fourth in rank of order.

I had applied for 60 days CCL for my minor son’s 12 th board examinations ,leave for first 15 days was sanctioned as CCl and for the remaining period i was pressurised to apply for E.L and I had to do so .that was my 2nd spell.Now i have again applied for 70 days CCl for my son;s entrance exams and counselling but ihave only been granted 30 days leave,althaugh i have 575 days CCL due.as my son is weak in academics and very sensitive please guide me what to do?

    i m working under said unit of central govt. i would like to know that how many spell the ccl can be taken? in one year how many time it cab be awail? how many days/ months it cab be awail in one spell?

    secondly, is da applicable under ccl? how the salary will count of the employee under ccl for full month/months? pls reply early as i want to go on ccl in short period …

CCL is granted upto 730 days for a woman employee for a maximum of two minor children. but it is not clear whether or not this means 730 days per child, ie a total of 1430 days in the case of two children, or whether it is 730 days total for two children which means a single child mother can avail of a maximum of only 365 days. clarification is required on this point since in the absence of clarity leave sanctioning authorities may tend to interpret it at will.

    1. Based on the present orders it is two years. If a female employee has one child and situation warrants that she might have to take leave for two years, it has to be permitted
