RTI reply of DOPT on the grade pay of ACP Inspectors of C.Ex

While grant of grade pay of Rs.5400 to Inspectors of Customs and Central Excise who have completed 4 years after receiving ACP is impeded by misinterpretation, another issue has come to lime light now in which even the very basic aspect of pay fixation in the event of ACP after 1.1.2006 has been done wrongly by Pay and Accounts authorities by misquoting the Resolution dated 29.08.08 of Ministry of Finance (Department of Expenditure) .

The condition No: 7 of Annexure-I to Original ACP order dated 9.8.99, which is in force, clearly says, “Financial upgradation as per ACP scheme shall be granted to the next higher grade in accordance with the existing hierarchy in a cadre/category of posts without creating new posts for the purpose”. So, the Inspectors who were in the pre-revised pay scale of Rs. 6500-200-10500 (S-12) are to be financially upgraded to pre-revised scale applicable to Superintendents of Central Excise and Customs viz., Rs. 7500-250-12000 (S14) and be granted the grade pay of Rs.4800, as the next higher grade to the post of “Inspector” in the existing hierarchy in the department is “Superintendent”. This practice which is in accordance with the law was followed without any confusion till the implementation of Sixth Pay Commission recommendations.

However, after issue of orders relating to 6CPC implementation, officers who have been accorded ACP after 01.01.06, have been denied the financial upgradation from pay scale S12 (Rs.6500-10500) to S14 (Rs.7500-12000) by the pay and accounts authorities in certain Commissionerates. Those officers have now been fixed with the grade pay of Rs.4600 meant for pre-revised scale S13. As such, there is no cadre exists in the department with the pay scale S13 (Rs.7450-11500).

Ironically, orders have been issued to those officers by the concerned heads of the department (after following all the procedures such as DPC etc meant for a promotion) for the financial upgradation from Inspectors with a pay scale of S12 (Rs.6500-10500) to Superintendents with the pay scale of S14 (Rs.7500-12000) only.

It was ascertained that financial upgradation from S12 to S14 was denied by pay and accounts authorities by taking refuge under Para 4 (iii) to Part-A of Resolution dated 29.08.08. However, Resolution dated 29.08.08 is misquoted for this interpretation. Resolution is only a para wise reply of the Ministry of Finance (Department of Expenditure) whether the recommendations of pay commission on a particular aspect is accepted or not. It is published in the Gazette of India, only for the purpose of transparency. In other words it is only policy frame work that has got no legal sanctity, and the statute known as CCS (Revised) Pay Rules 2008 which was notified by the Government for the implementation for the 6CPC would govern the pay and related matters of a Government Servant and would prevail over the resolution.

As per Clarification: 2 of Office Memorandum dated 13.9.08 issued by DOPT with reference to CCS (Revised Pay Rules 2008) it has been categorically stated that “Grade pay of higher Post” shall be granted in the event of ACP. The original ACP Scheme order dated 9.8.99 itself unambiguously defines this aspect and this is an additional clarification. As per ACP Scheme an officer who was granted the financial upgradation at the time of ACP, will not be eligible for any financial benefits at the time of his regular promotion. If the interpretation of Pay and Accounts authorities are accepted for argument sake, the ACP inspectors will have to be fixed in S13 (7450-11500) even after their regular promotion to the grade of Superintendents and granted the grade pay of only Rs.4600, while their peers receive the grade pay of Rs.4800/-.

This aspect has also been clarified by DOPT now while giving reply to the query under RTI Act by Shri.M.S.Venkataraman of Trichy as follows.

“The method of fixation of pay on promotion from one grade to another / financial upgradation under ACP has been clarified under clarification 2 of of the clarifications issued by this department vide O.M.No: 1/1/2008-IC dated 13.09.08”

Reply of DOPT is a fitting one and to the point. After all, one has to interpret law correctly and in the spirit of the law while implementing the same. Law making authorities can not spoon feed everything.

    sir,Iam in Defence civilian on technical post (TCM).I join this service in June1999 on basic pay (4000-100-6000) in highly skkiled .In old ACP after 12 years next promoted scale is 4200/-.Now in month of sep 2010 my department fixed in grade pay 2800/- As per new MACP in 6cpc.So please told me what can i do.And also my department not clear about 50% 50% for Highli skkiled workers HSI & HSII.Can i challenge about this in court or wait for government clarification.

    Once again I am disturbing u. I was working as UDC as on 31.8.2008 my Basic pay was 4800(pre-revised).  After Departmental Exam and subsequent interview I was selected to the post of Personnel & Welfare Inspector in the pre-revised scale of 5500-175-9000.. my pay was fixed as giving one increment with  and grade pay 4200.
    now I need clarification that
    1. whether I will get grade pay of 4600 as in the case of Assistants who have been now given grade pay 4600.
    2. In Railways the Welfare Inspectors are getting pay 7450 x 1.86 with GP 4600.
    3. In DDA the next promotion from Welfare Inspector is Senior Welfare Inspector (pre-revised scale  7450 x 1.86 with GP 4600) and there is no further promotion.

    for MACP promotions are to be determined by the Grade pay of the respective posts.
    In your case you had been appointed as UDC with GP 2400; promoted as TA(OLD)-Grade pay 4200; promoted as Inspector -4600; you have got two upgradations so no 2nd MACP. But you have completed 10 years in inspector cadre 11/2006 thus you are eligible for 3rd MACP to GP 4800 w.e.f 01/09/2008

    My details are as under:
    1. Date of Joining as U.D.C. in Central Excise: 30.12.1987 in Pay Scale of 1200-2040/-;
    2. Special Pay of Rs.70/- was granted in 1990;
    3. Promoted to the post of Tax Asstt. in Pay Scale 1220-2040/-
    ( Note: One third Post of UDC was upgraded to create new post of Tax Asstt).
    The Controlling Officer for the post of UDC and T.A. was Dy. Office Superintendent and thus there was no change in work assignment or hierarchy for the post of UDC and T.A..
    4. Promoted to the post of Inspector : 26.11.1996 in the Pay Scale 6500-10500/-.
    Thus in fact I was granted only one Promotion from UDC to the Post of Inspector where my immediate controlling Officer was changed from Dy. Office Superintendent (Gr. C) to Superintendent of Central Excise (Gr.B-Gazetted).
    Now,
    I have completed more than 13 years of Service in the grade of Inspector. Till date I have not been given benefit of ACP. Kindly let me know whether I am entitled for ACP, if yes form which date and at which scale. I shall remain grateful to you for your reply. Thanking you.

    I joined government service in pay scale of Rs.425-700 in May 1980 & got two promotions in pay scales of Rs.5000-8000 & 5500-9000. These pay scales have been merged with the pay scale of Rs.6500-10500. .The promotional hierarcy of our department is as under:
    Rs.4500-7000,5000-8000,5500-9000,6500-10500 & 10000-15200. What will be the next step of upgradation for me under the MACPS according to the 6th cpc. Will I get the benefit of upgradation. Kindly advise & clarify.

    “9. ‘Regular service’ for the purposes of the MACPS shall commence from the date
    of joining of a post in direct entry grade on a regular basis either on direct recruitment
    basis or on absorption/re-employment basis. Service rendered on adhoc/contract basis
    before regular appointment on pre-appointment training shall not be taken into
    reckoning. However, past continuous regular service in another Government
    Department in a post carrying same grade pay prior to regular appointment in a new
    Department, without a break, shall also be counted towards qualifying regular service
    for the purposes of MACPS only (and not for the regular promotions). However,
    beneflts under the MACPS in such cases shall not be considered till the satisfactory
    completion of the probation period in the new post.”

    It is furstrating that for the last one year i am waiting for reply of my query. but i have yet to receive the reply. may i request again on the following lines –

    I was appointed in 1991 in 5500-9000 scale. i went on deputation in 2002 in the same pay scale. in 2008 i was absorbed in another central govt. deptt. in the same scale. i have not been granted first ACP in the pay scale of 6500-10500 so far. kindly advise and clarify from which date i am eligible for 1st ACP and which deptt will grant?

    your gross will be 12540+4600(gp)+5999 (DA @35%)=23139; beside your get TA+DA and HRA as per the city where you are going to be posted. Minimum 1080 (tada)+1714 (HRA@10%) is assured.

    I would like to know the total take ome salary for that post as of now (i.e break up of basic pay,grade pay and also how much is the DA, HRA, TA etc)..  also how much is the yearly increment.  

    i am now workin in a bank with total salary of about 22 thousand.

    MACP Rule 9 indicate Rugular service from the Date of joining in the post. However, as per Court’s intervention you had been inducted in the seniority of 1998, it is pertinent that you will get your regular promotion as per that seniority only. Thus Years of Service reckoning for MACP should have to be from that date of 1998 and not from 2003

    I was selected in year 1998 year with other ten candidate. nine candidate allowed for joining in 1998 and department rejected my candidature according to laps in my qualification so I go to delhi hicourt for justis and in year 2003 court ordered to dept .for service with seniority from 1998 and I joind in year 2003 now my question is that can I found ACP IN 2008.

    I joined as TGT in 1986 in the pay scale of 440-750. In March 1998 I got SR SCALE of Rs 6500-10500 without any increment.In January 2000 I was directly recruited as PGT through DSSSB in the pay scale of 6500-10500 in the same DEPTT.Now sixth cpc has placed PGT in the GRADE PAY of 4800/. I want to know whether I will get MACP-1 wef 1-9-2008 ( completed 10 years in the same scale) or from 4-1-2010 ,the date of completing 10 years after direct recruitment.

Moreover I joined GOI in the year 1993 and have already been granted ACP in 5500 scale with GP 4200, what will be my grade pay in next scale ie. 6500 (PS). Kind tell me.

Please clarify from when can I get my ACP? Whether I will get ACP under old scheme or under New scheme i.e. MACP? How will may be fixed?     si r, I joined as LDC in defence accts Dept in 1976and promoted as auditor in the year 1981 due to my graduation got in the evening college, and I also got Sr.Auditor promotion wef 1.4.87 along with all the other auditors appointed as auditors, but to my surprise those who were appointed directly got acp in the year 1999 whereas i got this acp promotion only in the year 2005, However when 6th cpc was announced I got the grade pay of 4200,4600, and 4800 (acP) along with all those appointed directly, and even though I too have completed 30 years of service in 1976 only those appointed directly got MACPS wef 1.9.2008 , and not only that, all those who were 4200 got 4600, and those were in 4600 got 4800, and those who were in 4800 got 5400 wef 1.9.08 where as I have not received any promotion at all wef 1.9.08 and this is very upsetting me and made me a laughing stock among all others, hence please clarity or pl take this with the concerned authorities.

    It is submitted that I joined in service on 20.07.1993 as a Constable and granted benefit of ACP on 20.07.2005 for the Rank of Head Constable order the Provision of 6th Pay Commission Pay Ban was fixed Rs.7060+2400 (GP) as on 01.06.2006 and Rs.7650+2400 (GP) wef 01.07.2007, whereas a person who joined in my department (Central Government) on 18.03.2006 as a Head Constable has been fixed at Rs.7510+2400(GP). On 18.03.2006 and Rs.7810+2400(GP) wef 01.07.2007. Since I am drawing pay of Head Constable under ACP scheme wef 20.07.2005 my pay should be more in respect of person who joined on 18.03.2006 as Head Constable.

    It is therefore requested that necessary clarification may be issued in this regard.

    i am very perturbed and mentally very depressed. i had joined in central government office as pa in the year 1991. In the year 2002 i went on deputation to another central govt. department.     I am an employee of Nsso under Mos& PI in the department of Data processing devision.As per Seniority list my date of appoint 05.03.97,but My office illegially not to allow me to join that post of Data Entry operator Gr-B due to over age.As per court order my department compelled to allow me to join that post with same terms and condition.So I Joined that post in 31st March,2009 with notional benefit of pay fixation and seniority.But at the time of MACPS my office did not give me that facility.Please clarify me .

    I had joined NPL as Assistant (Stores & Purchase) Gr-III in the year 1990 in the payscale 3200-4900 later on I was promoted to next grade as Assistant (Stores & Purchase ) Gr-II in the pay scale Rs. 4000-6000 in the year 2000 . My next promotion is due on Nov. 2010 as Assistant Gr-I in the pay scale 6500-10500 . In case I get ACP what will be my grade pay Rs. 2800 or Rs. 4200/-. In case my department give me Grade pay, that is not my heirchy. Is it not unjustified to me? Kindly give clarification & oblige.

    The problem of ACP is presently hitting me hard. I joined in the C.Ex. Department in the month of January 1994 (Batch 1993) and i got ACP from January 2006 on wards as per the ACP Rules 1999. Consequent to the implementation of the 6th CPC, i was fixed at grade pay of Rs. 4800/- and first installments of arrears were drawn in the year 2008. I was subsequently promoted as Superintendent in May 2009 and joined in Vizag Zone. Recently, my Service book was audited by the PAO Audit team and objected my pay fixation and recommended for the Grade Pay of Rs. 4,600/- and raised objection for recovery of more than Rs. 16,000/- from my Second installment arrears and from my salary. To my surprise, i had not been served any intimation of recovery of dues either from my salary or from my second installment of CPC arrears but they withhold my Arrears and the same were not drawn till date even though all other officers arrears were drawn. When i enquired about the arrears they are informing me to deduct the recovery amount from my second installment amount but so far nothing has been materialised. For no fault of mine and availability of clear cut instructions as mentioned in the above mentioned RTI query, the department is unnecessarily delaying my payment and causing lot hardship to me under the cover false and baseless objection of PAO. Will u please clarify, the stand of mine is correct or not. Further, this should be clarified by the Government immediately otherwise this type of stupid objections will continue without any end.

    i have been tour within the city of mumbai and my headquarter and residence from the duty point is about 27 kms , i have submitted my ta bills , i have not claim for DA on tour but opted for mileage at the rate of Rs 8/- per kms which works to Rs. 432 at present my grade pay is Rs. 5400/- The office had limited my mileage to Rs. 150/ per day, please clarify my entitlement as per scpc.

    Is there any latest news about Steno scales/upgradation/merging. Since 6 CPC has recommended to change the designation as Executive Assistant, grade pay in subordinate departments for PS is only gp is 4200 which is a gazetted post. comparatively, in other department/goi, gazetted officers are getting 4800 gradepay and above. Being least bothered cadre of Stenos/PS, govt has ignored the upgradation of GP to 4800.
    I request the Anamoly committee to do justice for PS cadre in subordinate departments of GOI/MOD.

    i joined as JTA(chemical) in geological survey of india(WR),jaipuron the pay scale rs. 5000-150-8000.first ACP was granted to me w.e.f. of 01_09-2005 and my basic pay was fixed Rs.6500/- inthe pay scale of Rs.6500-200-10500/-.after implementation of sixth pay commission my basic pay is fixed on 1-1-2006 is Rs. 16290/-inpay band-2(9300-34800/-grade pay Rs.4200/-)and 1-7-2006 Rs.16780/-,on1-7-2007 Rs.17290 grade pay Rs.4200/-.

    I was promoted through DPC on 29-08-2007 in the SAME PAY GRADE rS.4200 in PB-2 for the post of senior technical assisitant(chemical). My basic pay before promotion was Rs.17290/-as on1-07-2007.

    kindly inform me that an extra 3% increment can be granted to meat the time of my promotion through DPC on 29-08-2007 and what will be my grade pay after this promotion on dated 29-08-2007.

Now the Accounts are telling that I will not get the promotional increment, since both the posts are in the same grade pay. Is that right. I have also noticed that clarifications were issued for fixing on promotion. In that I could see that FR22(1)(a)(1) is still holds good. pl. clarify whether one will get promotional increment or not.

    granting intermediate grade pay for acp does not fulfill the purpose of govt. to give at least 3 promotions in lifetime.if any person joins as an auditor ,gets promoted to senior auditor ,he has to pass SOGE in IA&AD where no regular promotions are there.So for them giving 4600 as 2nd ACP is injustice since after 30 years he will get 4800 grade pay
    as 3rd ACP makes him equivalent to Section officers with 4800 grade pay and denying 3 promotions in lifetime as he is getting only two promotions,1)auditor to senior auditor and 2) senior audito to SO equivalent grade which is next higher post in the hierarchy of his cadre. How then justice is done to the purpose of the govt. to give 3 promotions in a life time.Its a serious mistake done by the ministry of finance needs immediate rectification

    I m working in IA&AD dept. as senior auditor. I joined as an auditor got promotion as senior auditor and now after 21 years of service i m being granted 4600 grade pay.As a result after 30 years I will get 4800,which is the grade pay of section officer ,a grade next higher to my post in the hierarchy of my office.Is it not going against the assurance of the prime minister to give at least three promotions in life time? How the ministry of finance can do it?

    Asstt. Accounts Officers of Defence Accounts Department have been placed in PB2 with grade pay Rs.4800 while their counter parts in the Deptt. of Railway have been placed in PB2 with grade pay Rs 5400. Further, Section Officers of CSS are given grade pay Rs. 5400 after completing 4 years of service in the grade of Rs.4800.Why this facility/parity is not being given to the Asstt. Accounts Officers of Defence Accounts Officers?

    I do not know as to why nobody is talking about arrears of HRA for the period 01.01.2006 to 31.08.2008 as per revised pay. In this connection, for the purpose of clarity it may add here that I am not asking for HRA as per revised rate. According to OM dated 29th August 2008 of Ministry of Finance Department of Expenditure, HRA as per the revised rate comes to effect from 1st September 2008. To be more precise, prior to 1st September 2008, rate of HRA applicable in the city of Ahmedabad was 15%, which, according to above said OM stands revised to 20% with effect from 1st September 2008. This means the revised rate will be applicable from 1st of September 2008 only. There is no dispute about above stated position. I am not asking for HRA @ 20% from 1st January 2006, but I am talking about HRA at old rate (15%) but with reference to my new pay. The aforesaid OM is operative from 1st September 2008 which means, for the period prior to 1st September 2008 HRA at applicable rate would be available during the said period. It is beyond dispute that prior to revision of HRA vide aforesaid OM, HRA @ 15% of pay (Basic Pay + Dearness Pay) was admissible. Therefore the limited point to be determined here is what my pay was during 1st January 2006.

    3. According to the due drawn statement prepared at the time of drawl of arrears of pay, my pay as on 1.1.2006 was Rs.17040/- (Pay Band Rs.12840/- + Rs.4200/- grade Pay), therefore I become eligible for HRA @ 15% on my said pay. It is significant to point out here that we have been paid DA as per our new pay, but not HRA. Needless to mention here that a government servant cannot have two different pays – one for the purpose of DA and the other for HRA on a particular day. For example, if I have not been paid HRA as per my new pay during the period 1.1.2006 to 30.08.2008 there will be two different pays for me one for DA i.e. Rs. 17040/- (new pay) and the other for HRA i.e. Rs.10350/- (old pay) which sounds ridiculous. I have yet not come across any Instruction or OM directing not to give HRA for above said period on the basis of revised pay. Thus, it is felt that we are eligible for HRA at old rate but with reference to our new pay for the period 1.1.2006 to 31.08.2008.

    I was appointed as LDC on 14.08.1984. I got first promotion as Auditor in 1989, after passing Departmental Exam and promoted as Section Officer 29/7/1993 after passing the SOG Exam and thereafter as Asstt. Audit Officer on 30.07.1996. Now these two scale are merged with single grade pay of Rs. 4800/- as per 6th CPC. My question is when I have completed 16 years in one grade then I am entitled to get any finacial upgradation ? If so, when ?

    I am a steno Grade III and joined in Mar 1997 with revised pay scale 4000-100-6000 scale as per V Pay commission. I have completed 12 year in Mar 2009 and 10 years in 2007 without any promotion or ACP.

    Req clarify in what scale will I be fixed as per the MACP.

    I am working as UDC wef 27.01.1996 in the PS of 4000-100-6000 in KVS, and in my department my next promotion post is Assistant in the PB-2 (9300-34800) with Grade pay of Rs. 4200/-. Please let me know what will be my 1st ACP in PB 1with Grade Pay of Rs.2800/-
    or PB-2 with Grade Pay of Rs.4200/-, my department has sanctioned the PB-2 with Grade Pay of Rs.4200/- wef 01.08.08.

    As on 1.1.2006 my Basic pay was Rs.8825/- in the pay scale of Rs 8000-275-13500/-.in class -A category officer. My offices (CMFRI/ICAR/ Ministry of Agriculture) place me in the scale of 9300-34800/- with Grade pay 5400 in PB-2 in class –B. As per 6th pay commission’s recommendation which scale and which class I have to be placed in as on 1/1/2006.?

    Please let me know what will be my new scale of pay and class status as on 01.01.2006.

    As on 1.1.2006 my Basic pay was Rs.9500/- in the pay scale of Rs 7500-250-12000/-. As per 6th pay commission’s recommendation, on completion of 4 yrs service in the above mentioned scale I have to be placed in the pre-revised scale of Rs. 8000-275-13500/-(new scale being 9300-34800/- with Grade pay 5400).

    Please let me know what will be my new pay as on 01.01.2006.

    I am a stenographer in the pay scale of 4000/- as per 5th pay commission. I have completed 12 years in September, 2008. As per 5th pay commission next scale is Rs.6500/-. Please clarify from when can I get my ACP? Whether I will get ACP under old scheme or under New scheme i.e. MACP? How will may be fixed? Will there be any option for fixation under 6cpc w.e.f. the date of ACP? Please clarify.

    I joined in central govt. service on 10-09-1991 and got promotion as UDC w.e.f. 08-03-1999. Can I get IInd ACP w.e.f. 08-03-2009 after completing 10 years of service in scale of UDC

    Why a clarification is not issued by the Ministry /DoE in this regard to all concerns. Latest victim of this mis-interpretation is Vadodara Zone as again ACP is granted in the next grade i.e.Rs 4600 instead of next post, though the ACP is granted as per Original ACP Order 09.08.99 i.e 12/24 years scheme. This next grade is a recommendation of Modified ACP scheme which is yet to be implemented and still some part there of are being implemented and rest others are not. Now this has brought huge dis-parity as some of the Inspectors of 94 batch and 95 batch already granted ACP by issuing order in the year 2007 in the pay scale of Rs. 7500. Accordingly they got this pay from the date of completion of 12 years in the respective years i.e 2006 and 2007 till 30.08.2008. Thereafter, they were granted GP of Rs. 4800/- after implementation of 6th CPC. Now some how some Inspectors of 1994 and 1995 batch were left out of the said Order of 2007 and have been recently granted ACP in 2009 though w.e.f. from completion of their12 years of service in the year 2006 and 2007 as the case may be. But this up gradation is in the GP of Rs. 4600/- as per one of recommendation of Modified ACP scheme. Thus, this led various officers of 1994 batch drawing less pay than 1995 batch officers and similarly some senior officers of 1995 batch have to also draw less pay than their batch mates whose name were included in the ACP order of 2007. Thus officers who got ACP order late not lost out financially for two years but also in the fixation of pay vis-a-vis their batch mates who have joined the department simultaneously. So splitting of batches on part of the mis-interpretation of Account Officers has made it a complete chaos. I hope the reply to RTI query by DoE must be either circulated to all Commissionerates or one time clarification is the need of the hour, to show enlightened path to Account Officers.
