Non-Functional Financial Upgradation is ACP-DOPT clarifies

As per Part B and C of CCS Revised Pay Rules, 2008, Employees of certain Group B posts in various departments were fixed with the grade pay of ` 4800 and after completion of 4 years of service in the those posts, they are eligible for Non-Functional financial upgradation to the Grade pay of `5400/-

There is no confusion in this Upgradation but its effect on MACPS is the issue on hand now.

What will be the benefit under MACPS for an employee, who has been granted the grade pay of ` 5400 after completion of 4 years of service as per Part B and C of CCS Revised Pay Rules, 2008, as mentioned above?

Whether the Non-functional upgradation of grade pay from ` 4800 to ` 5400 after 4 years should be accounted as a promotion or ACP as far as MACPS is concerned? If this upgradation of grade pay is accounted as a promotion, obviously one of the three assured upgradations eligible under MACPS will be curtailed. We may think logically and say upgradation of grade pay from ` 4800 to ` 5400 under Part B and C of CCS Revised Pay Rules, 2008 is not a promotion. But, sources say DOPT has decided otherwise.

When Office of the Prinicpal Chief Controller of Accounts requested DOPT to clarify as to whether the grant of grade pay of ` 5400 in PB-2 alongwith the benefit of one increment of @3% may be treated as ACP or not, it has been clarified by DOPT to Principal Chief Controller of Accounts that the benefit of non-functional grade granted to the Superintendent (Group-B) officers after completion of 4 years would betreated as upgradation in terms of para 8.1 of Annexure-I of OM dated 19.05.2009 and the same would be off set against one financial upgradation under MACPS.

This decision is expected to result in reversal of MACP Orders issued to many of the employees who have been granted upgradation under MACPS recently by respective their administration.

  1. The central Govt has been very selective in implementing/extending the scheme of Non-Functional Financial Up gradation as envisaged in Part B and C of CCS Revised Pay Rules, 2008. This benefit has not been extended to all the departments. If this scheme is made effective from 01/09/2008 to all the departments many of the aberrations/anomalies created by MACP can be corrected to a great extent. For e.g. in IA & AD, there are instances that Asst Accts/Audit Officers (Group-B) who could not be covered under MACP are drawing less grade pay than the Sr.Accountants/Sr.Auditors who have bee granted III ACP. Further with in the cadre of Asst. Accounts Officer/Audit Officers there are instances of junior getting higher grade pay than the seniors. The scheme of MACP should provide for curing the anomaly or extend the Non-functional up-gradation, to up hold the principal that “under no circumstance a junior should draw more pay than the Senior and equal work equal pay”. DOPT should issue orders to extend this benefit to all departments with out waiting for the deliberation of National anomaly committee.

    I am working in the o/o the p.ag(a&e) as assistant accounts officer and i have completed six years of service in this grade. Do i eligible to get 5400 grade pay and in which pay band pb 2 or pb3.

    I was appointed in Dec 1987 (KVS, M/o HRD, GoI) (Shifted to Autonomous body, M/o MSME, GoI in the year Dec 1989) (Hyderabad) in the scale of 1400-40- and got the promotion in the year Oct 2001 in the pay scale of Rs.5500-9000 (Group B post). So far I have not got any ACP/MACP except one promotion in Oct 2001. When I will get ACP/MACP and scale of Pay after up gradation. Pl clarify

    i am working in a csir setup and entered the service 7years back in 6500 direct entry.after implementation of 6cpc i was fixed in 7450 with grde pay of 4600.the residency period for next promotion is 11 years.what is my fate.should i go to CAT

  5. But what about NFS granted in the year 2003? The benefit of FR 22 (a) (1) was not given at that time and there was no increment given while placing in the scale of 8000. I joined as SO in 1999 was given NFS in 2003. I have completed 10 years as SO in 2009, will I be given first Financial Upgradation under MCAP?

    I have joined in the year 1st Nov.1989 in the payscale of 6500-10500. I got promotion on 11.1.1996 to the pay scale 7500-12000. Now, my office has given non functional grade pay 5400 in PB-2 from 1.1.2006. i.e. after completion of 4 years in the pay scale of 7500-12000. I have completed 20 years service as on 31.10.2009. Whether I am elgible for MACP for getting grade pay of 5400 in PB-3 or 6600

    I was appointed in Dec 1987 (KVS, M/o HRD, Govt of India) (Shifted to Autonomous organisation under M/o MSME, Govt of India in the year Dec 1989, through proper channel) in the scale of 1400-40- and got the promotion in the year Oct 2001 in the pay scale of Rs.5500-9000 (Group B post). I will be completing 23 years by Dec 2010, So far I have not got any ACP/MACP except one promotion in Oct 2001. Now I am in the Grade pay of Rs 4200/-. When I will get ACP/MACP and scale of Pay after up gradation. As per Government decision that employees are permitted to revise their initial option up to 31.12.2010, If I get ACP/MACP, can I avail the revised option, so that I can get pay scale 9300 with Grade Pay of Rs 5400/-. Pl clarify.

  9. I have joined as Professional Asst(Library) in 20/10/1986 IN THE PAY SCALE 4000-6000. Later on Library Cadre Structure have been formed by UGC. Accordingly my pay scale have been revised to 4500-7000 with the assurence by the UGC that my 1st ACP would be 5500-9000,2nd ACP would be 8000-13500 AFTER COMPLETING 24 YEARS OF REGULAR service. As per the UGC notification to me,I was given 1st ACP of 5500-9000 from 2001 onward and subsequently I was placed in PB 2 with GP of 4200/-by 6CPC. Now I am about to complete 24 years of service,what will be my 2nd ACP as per 6CPC ?

  10. Upgradation of post/pay-scale happens outside ACP/MACP schemes and also outside the rules for promotion within the cadre. Grant of NFS is one such upgradation outside the scope of ACP/MACP and promotion schemes. If one cares to read the rules, grant of NFS does not fall within the ambit of promotion because the rules for promotion prescribes several conditions like seniority, merit, zone of consideration, etc. For grant of NFS, a screening committee is constituted and vigilance clearance is obtained. Even if the composition of the Screening Committee is the same as that of DPC, Screening Committee cannot be termed as DPC. Thus, NFS is outside the purview of promotion.

    Similarly, ACP/MACP carries certain conditions and these conditions vary from NFS and therefore, treating NFS as one ACP/MACP upgradation would not sound correct.

    Rules can be made or existing rules may be amended to treat NFS as ACP/MACP, but the rules will only have prospective effect i.e. it will apply to the ACP/MACP upgradation due on or after the date of the rules so made/amended and not before.

    1. Dear David
      During 2010 only your 24 years is completed when ACP scheme is not operative. Thus you are eligible for 2nd MACP wef 1/9/2008 (20 years completion on 20/10/2006) with GP 4800

  14. Please clarify, whether the person promoted in pre-revised scale 6500-10500 (Gazz.) after 1.1.2006 but before implementation of 6th CPC, is entitled for GP 4600 or not as it has upgraded in 7450-11500 with 4600 GP w.e.f. 1.1.2006.

  15. Dear Sir, Section Officers in Maharashtra who completed 4 years of service were granted non-functional upgraded pay scale of 8000-12000 from 6500-10500. However, unlike their counterparts in the Central Govt. who were included in PB-3, all such Section Officers of the State have been included in PB-2. What is the remedy

    I joined CG service as pharmacist with pay scale 4000-100-6000 on 01.01.1992. I was placed in 4500-125-7000 scale from 01.02.2003. Now as per revised pay structure of Pharmacist OM No 1/1/2008-IC, GOI, Min of Finance, Dept of expnditure, Implementation cell dated 18.11.2009, pharmacist non functional grade has been ordered and I am placed in PB 2 with GP 4200/- wef 01.01.2006. please clarify whether I will be eligible for GP pay of 4600/- or 4800/- after completing 20 years on 01.01.2012. as the new MACP order for pharmacist says 1st MACP = 4600/-, 2nd MACP=4800/- & 3rd MACP=5400/-. please reply.

  17. I joined as PA on 21.1.90 in an autonomous body in the scale of Rs. 1640-2900. On 13.3.97 promoted as PS in the grade of Rs. 2000-3500. After 6th CPCP they have placed me in GP of Rs. 4600/-. When and in which GP I will get MACP; please help. Secondly presently I am on deputation, whether repatriation will be required or not for getting MACP or ACP

  18. appointed as P.A in Non-cadre post under Planning Deptt. ( 1976) ( after formation of Jharkhand one sanctioned (5500-9000) P.A post changed to non-cadre post from Personnel Deptt. then absorb me as P.A . in the planning department. after my retirement this post will go back to peprsonnel deptt. Now I got ist ACP ( 6500-10500) 2nd acp (10000-15200) . Now the Finance department downgraded my 2nd acp dur to non-cadre post . only get next grade only ( 7500———- i.e. grade pay 4800) . Kindly clarify and forward if any order in this regard which is favour to me. before formation of jharkhand i got all benefits of P.As working in personnel department.

    In IA&AD, The post of Section Officer (pre-revised pay scale 6500-10500 and Pre-revised Pay Scale taken for Revised Pay under 6CPC 7500-12000) was merged with Assistant Audit/Accounts Officer (pre-revised pay scale 7450-11500 and Pre-revised Pay Scale taken for Revised Pay under 6CPC 7500-12000) as per 6CPC and given new pay band of Rs.9300-34800 with Grade Pay Rs.4800.

    As per the article, whether personnel at merged cadre are eligible for non-functional upgradation of grade pay at Rs.5400 ? If not, Why?

  20. I joined in statutory Govt. Body under GOI as Steno (330-560 pre-revised) in March,1983 : Promoted in 1400-2600 pre-revised in Nov.1992, promoted in 5500-9000 in Jan.1997, Promoted as Sr.P.A. 6500-10500 (Gazz. B Group) in June, 2008 i.e. before implementation of 6th CPC. Please clarify, what GP will be applicable on me. Presently I have been fixed under 4200 GP. But the DoPT has issued OM 13 Nov.2009 upgrading the Scale of pay with GP 4600. Many of the persons joined the service after me have upper by taking ACP and after existance of MACP….may be 4800 & 5400 GP.

  21. I am working as Assistant Directors in Department of Telecom in the pre revised scale 7500-2500-12000. I Joined as Junior Telecom Officer in Pre Revised 6500-200-10500 with Group B Gazated RR is Engineering qualification for JTO . Jto is promoted to AD.
    In 6th CPC common recomendation JTO Pay scale is revised to 7450 from 6500. But as there is no recommendation for TES Group B i,e AD in depart of telecom they have fixed JTO in PB-II in GP 4600 for JTO and AD GP 4800. After 4 years of services also Department is not giving GP 5400 either in PB-II or PB-III. DOT is telling that department of expenditure has rejected the case.

    Plz guide me how to tackle their injustice

    I joined in may 1984 as Bg B non Gaz as dir recruit and then dec 1996 as Bg B Gaz in the scale 6500 in the same department .Kindly advice am I not entitled to get 2nd ACP?

  23. nfsg from gp 4800 to 5400 in pb-2 available for superintendent of customs should be counted against an up gradation, if it was allowed in between 01.01.06 to 31.08.2008. However, such up gradation is allowed w.e.f. 1.9.08 onwards(the of commencement of MACP), then , it should be counted against an up gradation in terms of para-8.1 of OM dated 19.5.09

  24. I have recently got promotion in pay band 9300-34800 and Grade pay is 4600/-. But I am drawingG.P as Rs.4800/- in the same pay band as per ACP Scheme. My question is whether any increment shall I get on my joinint in promotional post
