Can we revise FR 22 fixation Option ?

After implementation of Sixth Pay Commission report there are various situations where an employee will be getting lesser pay than his junior. Normally, we can claim for removal of such pay anomaly as per procedures laid out.

However, in one of such situations employees may not be in a position to claim removal such anomaly. This situation was highlighted by Mr.Rajasekar, Intelligence Officer, Directorate of Revenue Intelligence, Chennai, who is a GConnect user. He explains that an option exercised under FR 22 (I) (a) (1) for postponement of increment may be a cause for receiving lesser pay than your juniors, when pay fixation procedures were changed on a later date by the Govt. This situation is explained below.

Two gentlemen A and B joined in Central Government Service in the same cadre on a same date during April 1994. Based on ranking in the selection examination & interview Officer B is junior to the Officer A. Till a particular period, both drew same salary and their increment month was April of every year. After implementation of 5th Pay Commission report with effect from 1996 by Government, they claimed to remove a pay anomaly as one of their juniors viz., Officer C, was drawing more pay than them. Since the said junior’s increment month was fixed in January he was getting more pay than Officer A and B. The claim of Officer A and B along with others who were sailing in the same boat were considered and their increment month was also advanced to January.

Afterwards, on 01.04.2004, the pay scale of the cadre in which Officer A and B are working was upgraded to the next pay scale. On account this up- gradation of Pay Scale, Officer A and B exercised their option for fixation of pay under FR 22 (I) (a) (1). Interestingly, this time, Officer A opted for pay fixation on the date of up-gradation (i.e.) on 01.04.04, and thereafter he started getting his annual increment in April. However, Officer B opted for pay fixation on the date of his next increment (i.e.) on 01.01.05 and he continued to get his annual increment in January.

Now, comes the implementation of Sixth Pay Commission report which paved the way for uniform annual increment in July for all employees. This causes fixation of lesser 6cpc revised pay for Officer A when compared to Officer B and C who are juniors to him. This is because Officer A is fixed with 6cpc revised pay on the basis of his pre-revised basic pay for which annual increment for the year 2006 was yet to be given as on 01.01.2006, as Officer A was due for his next increment only in April 2006.

From the above illustration, it could be understood that the change of increment month in respect of Officer A from January to April during 2004, is the cause for fixation of reduced revised pay to Officer A though he is senior to Officer B and Officer C. Whether this increment could be re-fixed to January as on 2004, for consequent higher pay benefits to Officer A ?

Mr.Rajasekar is of the view that as per the Office Memorandum No: 16/8/2002- Estt (Pay-I) dated 25.02.03, issued by DOPT, in the event of unanticipated developments or change of rules etc., the option exercised under FR 22 (I) (a) (1) by the Officer A for fixation of revised pay on 1.04.2004, consequent on his appointment in the higher grade on 1.4.2004, could be revised so that he in his revised option letter can opt for fixation of revised pay on the date of his original increment due in the year 2005 (i.e.) on 1.1.2005.

The text of the relevant Office Memorandum dated 25.02.03 is reproduced below. (Reference- Swamy’s Fundamental Rules – FR 22 – Para (17-A) page 57)

“A demand was raised by the staff side in the National Council (JCM) that a Central Government Servant may be allowed to revise the option exercised by him on promotion/appointment on higher grade/Post under FR 22 (I) (a) (1) in the event of unanticipated developments or change of rules, etc. The staff side had also demanded that a specific provision to this effect be incorporated in the existing rules/orders.

2. The demand of staff side has been examined by the Government and the President is pleased to decide pursuant to any unforeseen developments or change of rules, a Government Servant may give revised option for pay fixation under FR (I) (a) (1) within one month from the date of orders of such unforeseen developments or change of rules. Acceptance of such revised option may thereafter be examined and decided on merits by the Ministry/Department concerned with the approval of Department of Personnel and Training. In case it is decided to allow fresh option to the Government Servant concerned, the option once exercised shall be treated as final. The past cases of similar nature can be referred to this Department which will be decided on merit “

I reached to the maximum of pay scale on 1.1.2000 i.e Rs 11500 in pay scale of 7450-225-11500 and got increment of Rs 225 on 1.1.2001.Next increment of Rs 225 i got on 1.1.2003 making my pay 11950.Next increment of Rs 225 i got on 1.1.2005 making my pay 12175 on 1.1.2006 my basic pay was Rs 12175. I got promotion on 16.11.2006 in Group A entry present pay scale 8000-275-13500.What will be my basic pay on 31st january 2007 since i was superannuated on 31.1.2007…SEND COMMENT ON THIS ISSUE..

I have been promoted in the scale of pay of Rs.7450-225-11500 with effect from 3.2.2004 and I opted to fix my w.e.f. 3.2.04 with DNI 1.2.2005, whereas my date of increment in the lower scale of pay Rs.6500-200-10500 was 1.1.2004. Consequent on 6cpc, I am not eligible for increment on 1.2.2006 and my increment is postponed to 1.7.2006. If my option is revised opting pay fixation w.e.f. 1.1.2005 under FR 22(1) (a (1), on promotion to the scale of pay of Rs.7450-225-11500 w.e.f. 3.2.04, I would have got the increment on 1.1.2006 and it is beneficial to me. I have already requested the authorities for revising my option but no positive response forthcoming. Please comment whether I am eligible for option revision in terms of DOPT OM dated 25.2.2003.

  5. Sir, I was appointed in april 2002 in scale 3050-4590 and got promoted in july 2007 in scale 4000-6000. As on 1-1-06 my basic pay was 3425/- and increament date is 01-04-06 , when i got promoted in scale 4000-6000 on july 2007 and increatment month changed to july,as on july 2008 my basic is 4100. But my present basic pay as on 01-09-2008 is 9530/- . So I request to please send me details about basic pay and arrears,

  7. Is Office Memorandum No: 16/8/2002- Estt (Pay-I) dated 25.02.03, issued by DOPT, is still valid as in my case , my office is saying that ” All the orders related to 5th CPC has no meaning after the 6th CPC” and we have to wait for similar order from DOPT rel;ate to 6th CPC.
    Any one have any idea about new order from DOPT for such cases.

    My basic Pay as a captain on 1.1.06 was Rs. 9600 and my rank pay was Rs. 400. I got promoted to Major in pay scale 11600 and rank pay 1200 in dec 2006. When i received my salary statement which was having the revised salary of 6CPC my basic pay is 22380. Grade pay is 6600. When asked to exercise option for pay fixation what should be my bid. My calculations show that i should be getting a basic pay of 25000 plus.

    I joined the Central Gov.Srvice on 26.10.2006 in Pay Scall of 6500-200-10500 as an inspector of central Excise $ customs. after implimentation of 6th CPC we are get getting lesser pay than inspectors who are promotted from Sr.TA.in May 2008 and DOS which exiting scal is 5500-175-9000.can we claim for removal of such pay anomaly.Please send me comments.

    This is Alok Singhal working in Heavy Water Plant KOTA Dept.of Atomic Energyas a scientific Asstt. Grad F . My basic was Rs. 10475/ in Grad 8000-275-13500 my date of iccement is Feb. and my date of promotion is Aug. IN the month of Aug 2005 I promoted to SA/F In the Grad of 10000-325-15200. I opted option II in FR22 Ia I . I was fixed on Rs. 10650/ on 1-1-2005 and my refixed in Feb 2006 to Rs. 11300/. I opted pay commssion from 1-1-2006 and my Dept. fixed my basic on basis of my pay on 1-1-2006 as Rs.19810plus grad pay Rs 6600. they are not considering my refixation on 1-2-2006 . Can any one advice the solution of this problem From where I can get justice I will be very thankfull.

  13. I am working in a public sector Undertking. After the current pay revision my junior whose basic was less than my basic has started drawing higher basic. Is it a case of Anomaly? The junior is working under me and is of different cader!

    My basic was Rs.5675/- on 1-1-2006 in grade 5500-175-9000. I opted 6 CPC from 1-1-2006 and my pay fixed in PB-2 with grade pay 4200.
    I got promotion from october 2007 in PB-2 with same grade pay 4200,promotion result declared on march09 .
    according to 6 cpc this promotin is vaild ?
    please clarify this

  16. Before Vi cpc my basic was Rs. 5150 (5000-150-8000). My office upgraded the scale from 1.2.06 to 5500-175-9000 and my basic was fixed at minimum of Rs. 5500 w.e.f. 01.02.2006. On implementation of VI Cpc the option was asked by my office on war footing to give as 1.1.06. Then a ciruclar was issued by my office stating to give a 2nd option. Then I opted as ” my pay fixation w.e.f. 01.01.06 with basic 5150 and again refix my pay in upgraded scale i.e., Rs. 5500/- w.e.f. 01.02.2006. Again the pay fixation cell of my office asked to change the date of option as 01.07.2006 as 01.02.2006 would not be beneficial to me. I changed my option date in the same option form as 01.07.2006. Now my office is in total confusion to give me the correct fixation. Can you please help me as I will be put to huge loss life long. Thank u in anticipation for ur reply.

  17. wITH REFERENCE TO ABOVE, CAN I CHANGE THE DATE OF OPTION FOR FIXATION (VI CPC) IF I AM NOT SATISFIED AS MY JUNIOR’s PAY IS MORE THAN MY PAY AT THIS STAGE.

  18. I was appointed as clerk on 21/12/1989 in the O/O. The Accountant General (A&E)-II, Maharashtra, Nagpur.
    After passing my SOGE exam I went on deputation as Section Officer in the O/O. The Accountant General (Audit)-II, Maharashtra, Nagpur on 16/5/2005 and in mean time got proforma promotion as Senior Accountant in my parent office in the month of June, 2006.
    After passing the Section Officer (Civil Audit) exam got eventually absorbed in the O/O. The Accountant General (Audit)-II, Maharashtra, Nagpur w.e.f. 1/12/2006 (on deputation in the same office w.e.f. 16/5/2005).
    Now while exercising the option for fixation of pay as per 6th pay commission I have opted my option w.e.f. 1/1/2006 and accordingly my pay was fix in month of June, 2009 in which there was substantial loss in my gross pay.
    Now I want to change my option i.e. from the date of absorption as section officer (1/12/2006) for which I have given a representation quoting the OM dt. 29/1/2009, but same was rejected by the office stating that the option once exercised cannot be changed and the OM dt. 29/1/2009 is for split option and it does not apply in my case.
    Kindly suggest me whether I can change my option in this situation or is there any way so that I can exercised my revised option.

Dear sir on 1-1-2006 i was system attendant in pay scale 4000-6000 basic was 4700 other employee was tech B in same 4000-6000 pay scale basic was 4900 in may 2006 i was appointed tech A in 5000-8000 scale on direct requiret that employee in august pormoted as tech a 5000-8000 scale on my same department in may his basic was 4900 my was 5000 we get same basic till 2008 in old pay scale but in revised pay scale that employee getting more pay from me but as tech A hi is junior to me please give suggestion

Then I was classified in pay scale 5500-175-9000.I want to opt option from date of classification (01-10-2007).But office do not give .My fixation fixed from 1-1 -2006 which is not benificial to me so i want to change my option. Mr.A was promoted as Steno Gr.II & Mr.B promoted as Steno Gr.II in 1989 and 1986 respectively by competiting departmental test. As on 31.12.1986 Mr. B was drawing Rs.902 as basic pay and Mr. A was drawing Rs.895. As on 31.12.89 Mr. A & Mr. B were drawing Rs.962 in the old scale but in revised scale, A was drawing two increment than B . Is there any anomoly ? If yes, what FR.22 says in this regard or any other rule is applicable in this regard because FCI authoriuties has refused to remove the anomoly without giving any satisfactory reply. Who is the right person to be contacted in the Ministry of Consumer Affair and Public Distribution. Can B get his equavalent to A in revised scale w.e.f. 31.12.1989? Guide me.

  26. I would like to know the rules or board’s circulars for pay anomaly.
    I was promoted as Inspector on 18-04-2008 and pay fixed accordingly. Another Inspector joined during Sep-2009. As per the 6th pay commission report, in the grade pay of Rs.4600, the new officer who got appointed in Sep-2009 is junior to me and is drawing the basic pay of Rs.17140 as per the fitment table. Whereas my basic pay is presently at some Rs.16500 and odd. Now what is the authority to claim pay anomaly ?

  27. The case of Shri Srinivas M V is of stepping up. He can claim stepping up with his junior if he is drawing more pay due to this Pay Commission. But DDO and PAO will disturb him as usual. But do not loose heart keep fighting. Stepping up at par with junior is ultimate right.

  28. I was appointed as LDC in the pay scale 3050-4590 on 08 May 1995. 1st ACP has been granted to me on 08 May 2007. Pay has been fixed @ Rs.4100/- PM wef 08 May 2007 after grant of Annual increment for the year 2007 without making an option(which was granted on 01 May 2007). Now pay has been fixed on 01 Jan 2006 as per the provision of 6th CPC. Now I have made an option to fix my pay wef 01 Jul 2007 on grant of 1st ACP after grant of Annual increment for the year 2007. But Audit authorities does not agree stating that you can not make an option as you have not given such type of option at the time of fixation of pay in pre-revised scale. request clarify that Can I make an option now.

  29. Mine is also similar case. I was appointed as Associate Professor in the scale of 16400-450-20000 on 1.8.2001. So I opted the revised pay scale on 1.1.2006. On 15.4.2008, I got appointed to next post of Professor in same institute in the scale of 18400-500-22400 (administration calls it as direct recruit, but I feel it is promotion as I am internal candidate). Now pay scales are revised. I requested for another option for the post of Professor (i.e. pay to be fixed on date of next increment i.e. 1.7.2008). Administration denied the same saying that I do not have any option on 15.4.2008. This creates the anamoly which is
    If I would have joined after three months or somebody from outside would have joined after three months his salary would have been more. How it can happen? Also, people would not like to join between 2 nd Jan. to 30th June as they may be at loss. I feel meaning of promotion should be clarified. Also, people should be given option of for exercising new option if they got selected / promoted after 1.1.2006

Earlier I was holding the post of L D C on since 31.08.1998 and my basic pay was 3575 as on 01.01.2006 and my earler increment month was August. On the implementation of 6th CPC I opted to draw arrear since 01.01.2006 and my pay was fixed on 10570/-( 7770 + 2800(GP) ) which is lower than the minimum pay fixed for new entry on the post of Accountant, which is 11360/(PB+GP). However I have drawn arrear. In vew of recent development in anomaly committee whether I may get the minimum pay of 11360/-(PB+GP) instead of basic 10570/-. If positive please submit me copy of reference please.

  31. I am working in NMDC Limited, a Public sector Company. I was working in the post of Maintenance Assistant ( RS 02 Grade). Later on I was selected as HEM(Mech) (RS 04 Grade) after internal notification circulated by the Management for said post to Departmental employees. In the post of HEM(Mech) (RS 04grade), I was kept for 18 months training period in which I was getting emoulment of my previous post i.e., of RS 02 grade. after successful completion of my training period of 18 months, My Basic pay was to be fixed. kindly clearify that weather I will get notional Increment of RS 04 grade while fixing the Basic of my new pay scale of HEM(Mech) RS 04 grade.

    1. Anomaly committee’s final decision is yet to come. Only upon a OM clarifying the position your query can be answered

  33. my case is officer A and B joined in1989 in same cader drawing same basic till 2001 A was senior to B in selection both were promoted in 2001 in same list again drawing same pay in2003 july A promoted in higher scale and fixed higher pay in 2008feb B promoted on the same grade and by taking option to fix injuly reached higher than A my question is can A can take pay parity at par with B as per FR 22 1 a

    I joined I.C.A.R. on 10th August 2006 in the pay scale of Rs.12000-18400 as Senior Scientist. One of my colleagues joined in this cadre on selection from the lower cadre (from the scale of Rs.10, 000.00-15,200.00 pre revised with a basic pay of Rs.12960.00) in the month of June 2007. As he was having higher basic pay at the time of joining to my cadre his pay was fixed accordingly. In fact I used to get less pay than my junior. Now my question is whether I can get the benefit of FR 22 or not?

    I was promoted to the post of Foreman (G)in the pay scale of 7450-225-11000. wef 06-01-2006.and my payment was fixxed as per the recruitment rules in force on that time.Postdeclaration of 6th CPC the pay scale of 6500-200-10500was merged with the pay scale of 7450-225-11500.Now the paying authorities are claiming that since these two posts were merged together i am not eligible for the promotional benifits allready granted to me by fixation of pay. and they are recovering the money at the rate of one increment ,Now if somebody advice me as to what cource of action is availiable to me.     I would like to request you for your kind attention on my following few lines in respect of Pay Anomaly as on 01.01.2007 comparing with my juniors ( after fixation in revised Pay Scale ).

    Mr. S.K.Patro, Manager is junior to me ( In respect of departmental seniority as well as in existing basic Pay ) as on 31.12.2006. My Basic pay was Rs. 15,800/- as on 31.12.2006 ( My annual increment date is July 1st) where as Mr. Patro’s Basic Pay was 15,450/- as on 31.12.2006 ( His annual Increment date is January 1st ).But as per Departmental New Pay commission rules my Basic pay has been fixed at Rs. 36,610/- ( Thirty six thousand six hundred and ten only ) as on 01.01.2007, in the revised pay scale. However, on the contrary Mr. S.K.Patro’s, Mgr, Basic pay has been fixed Rs. 36,880/- ( Thirty six thousand eight hundred and eighty only ) as on 01.01.2007.
    Mr. Patro’s increment date was on 01.01.2007 and my increment date was 01.07.2007.Departmental Pay commission report implemented from 01.01.2007. Now My question is my junior how he could get more pay than me on 01.01.2007 and whether I could get benefit through FR22 (a)(i).What is FR22(a)(i) rules! Can any body help me in this regards.

      You are not clear in Question. Taking that in your Dept (most probably any State Govt) 6CPC implemented wef 1/1/07, there may be chances of your junior may get higher fixation due to his increment date 1/1/07 before CPC. But in 6 CPC OM itself remedy has been given under Note 7 of Rule 7 of CCS ( RP Rules) 2008 by which Senior’s pay will be stepped up to that of Junior wef date of initial fixation itself. Certainly similar Note will be availble in your Govt.’s Notification also. Check up and claim

    With an humble request, I beg to state that I had joined as TGT (Hindi) on 12/09/2007(After noon) on promotion in the pay scale of Rs. 5500 -175-9000 plus usual allowances as admissible under the rules, with immediate effect from primary teacher. On the joining, my pay was fixed Rs. 6025/- on dated 13/09/2007 in the pay scale of Rs. 5500 -175-9000. According to 6th pay commission by my pay was revised as Rs 16180 (Rs. 11580/- as pay +Rs. 4600/- as grade pay)

    Pay of fresh TGT is fixed as Rs 17140 (Rs. 12540 as pay +Rs. 4600 as grade pay) who has join after my promotion.

    According to the Directorate of Education order No. 806-816 dated 12/09/2008, my pay may be revised as Rs 17140 (Rs. 12540 as pay +Rs. 4600 as grade pay) on dated 13/09/2007 as well as starting pay of TGT.

    Please, inform me, what my pay is on 13/09/2007.

Why promottee TGT from MCD in Delhi Govt. directorate of education are not treated at bar with direct recruited TGT after 6th pay commission by denying them the basic salary of Rs. 17140/-, the minmum given to direct recruited TGTs. Why the promottee teachers are 70% of the total TGTs are harrassed and government want that they should approach court for parity in pay.
